HomeMy WebLinkAboutCity Council Resolution 1990-425CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 16th day of July , 1990 The following members were present: t`nnnni l±n�+nt.�ra He t ; w.t 1 i Ri�tior,Vasiliou, and Zitur The following members were absent: Mayox Bergman Councilmemher Zitur introduced the following Resolution and moved its adoption: RESOLUTION 90-425 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN CONDITIONAL USE PERMIT AMENDMENT FOR GEOFFREY GAGE FOR KINGSVIEw HEIGHTS SECOND ADDITION (90047) (RPUD 85-1) WHEREAS, Geoffrey Gage has requested approval for a Conditional Use Permit amendment to the Residential Planned Unit Development Plan for Kingaview Heights Second Addition to permit the construction of a cedar board fence on Lot 5, Block 7 which does not have a principal structure on that lot with the owner's permission; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; 10 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Geoffrey Gage for a Conditional Use Permit amendment to the Residential Planned Unit Development Plan for Kingaview Heights Second Addition to permit the construction of a cedar board fence on Lot 5, Block 7 which does not have a principal structure on that lot with the owner's permission, subject to the following conditions: 1. No other amendments or variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced including fence permit requirements; no Code requirements are waived by this approval. 3. The granting of the permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans. 4. Compliance with applicable provisions of Resolutions 85-155 and 85-479. 5. A copy of this resolution shall be filed on both 14515 -44th Avenue North (Lot 6, Block 7) and on Lot 5, Block 7, before a fence permit is issued. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell , and upon vote being taken thereon, the following voted in favor thereof: era Helliwell, Ricker, Vaailiou, and Zitur The following voted against or abstained None _ whereupon the Resolution was declared duly passed and adopted.
