Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 4th day
of June , 19-10 The following members were present:
Mayor Bergman, Councilmembers Helliwell Ricker_ Vasiliouand Zir„r
The following members were absent: None
Councilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 90-345
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
EIDEN CONSTRUCTION, INC. FOR "HAWTHORNE PLACE" (90006)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Eiden Construction, Inc. for "Hawthorne Place" located west of Highway 101
and south of 8th Avenue North;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing the Final Plat.
3. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water, and the MPCA Permit issued.
4. Removal of all dead or dying trees from the property at the owner's
expense.
5. Minimum yard setbacks shall be 35 feet for the front yards, 15 feet for
the side yards, and 25 feet for the rear yard.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. Street names shall comply with the City Street Naming System.
8. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.

9. Private drive access shall be limited to internal public roads and
restricted from 8th Avenue North.
10. The developer shall comply with those provision of City Council Resolution
89-439 regarding tree perservation that apply.
11. The Development Contract, as approved by the City Council together with
all lender acknowledgements, shall be fully executed prior to release of
the Final Plat.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Ricker , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Bergman, Councilmembers
Helliwell, Ricker, Vasiliou, and Zitur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
