HomeMy WebLinkAboutCity Council Resolution 1990-334CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 4th day of June , 19_20_ The following members were present: Mayor Berman. Councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent:_ None CouncilmemberRicker introduced the following Resolution and moved its adoption: RESOLUTION 90- 334 DENYING APPEAL OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULE REGARDING PROPERTY AT 845 RANCHVIEW LANE (05-01-90) WHEREAS, the Community Development Director has appealed the May 15, 1990 Board of Zoning Adjustments and Appeals ruling granting a variance to Mr. Gregory Bohnert for a reduced side yard setback distance from an attached garage at 845 Ranchview Lane North; and, WHEREAS, the basis for the appeal is that the variance would constitute an undesirable precedent noting the reference in the application to prior similar variances as precedent for this variance; and, WHEREAS, the City Cou.lcil has reviewed the appeal, additional information supplied by the property owner, and the Board of Zoning Adjustments and Appeals record of May 15, 1990; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that is should and hereby does deny the appeal by the Community Development Director of the Board of Zoning Adjustments and Appeals action of May 15, 1990 granting Mr. Gregory Bohnert, 845 Ranchview Lane North, a variance, based upon the following: 1. The Zoning Ordinance variance criteria have been met. 2. The variance is for 3.9 feet to allow an 11.1 foot side yard setback for addition to the existing attached garage. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell. Ricker. Vasiliou, and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
