The following members were rresent: , Mayor Bergman, Councilmembers Helliwell- Ricker, Vasi 1 in,:. and Zl tier , The following members were absent: Nnne Councilmember Ricker its adoption: introduced t:ie following Resolution and moved RESOLUTION NO. 90-304 REQUEST FOR PAYMENT NO. 22 AND FINAL ZACHARY LANE WATER TREATMENT FACILITY CITY PROJECT NO. 431 WHEREAS, the City of Plymouth as owner and Shaw Lundquist Associates, Inc. as contractor, have entered into an agreement for Zachary Lane Water Treatment Facility, City Project No. 431, said agreement being dated May 20, 1987; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $3,500,956.00, eight change orders were approved in the amount of $98,671.73 and the value of the work to date is $3,599,627.73 and is herewith approved. 2. That the work performed by the Contractor for the Zachary Lane Water Treatment Facility and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 22 and Final in the amount of $19,455.00 to Shaw Lundquist Associates, Inc. for Zachary Lane Water Treatment Facility is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman.
