HomeMy WebLinkAboutCity Council Resolution 1990-296CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 7th day of May , 1990 The following members were present: Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION 90- 296 APPROVING CONDITIONAL USE PERMIT FOR HOLIDAY PLUS (90021) WHEREAS, Holiday Plus has requested approval of a Conditional Use Permit to conduct outdoor display and sale of bedding plants of approximately 1,200 square feet at the southwest entrance of the store during the months of May and June each year for property located at 4445 Nathan Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Holiday Plus for a Conditional Use Permit conduct outdoor display and sale of bedding plants of approximately 1,200 square feet at the southwest entrance of the store during the months of May and June each year for property located at 4445 Nathan Lane, subject to the following conditions: 1. The Conditional Use Permit shall be renewed annually prior to the beginning of the outdoor display event. 2. The site shall be maintained in a sanitary manner and should the petitioner fail to comply with this provision, store management shall be notified of the irregularity, and given 24 hours to comply. In the event store management does not comply, the City shall proceed with the necessary corrective work and assess the cost against the property. 3. Access to parking, driving lanes, or fire lanes shall not be obstructed. 4. No other outside display of merchandise shall be allowed unless specifically allowed by a new or amended Conditional Use Permit. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Ricker , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers _He11iwe11, Ricker- Vasiliou and Zitur The following voted against or abstained None lihereupon the Resolution was declared duly passed and adopted.
