Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 7th day
of May , 199_ The following members were present:
Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur _
The following members were absent: None _
Councilmember Ricker introduced the following Resolution and
moved its adoption:
RESOLUTION 90- 295
APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN CONDITIONAL USE PERMIT
AMENDMENT FOR ARNOLD HAUGDAHL (90018) (RPUD 80-1)
WHEREAS, Arnold Haugdahl has requested approval of a Planned Unit Development
Plan Conditional Use Permit amendment to Plymouth Creek for property located
at 4064 Quantico Lane to allow encroachment of 5 feet into the PUD common open
space for construction of a three season porch of 12 feet by 14 feet; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Arnold Haugdahl for a Planned Unit Development Plan Conditional Use Permit
amendment to Plymouth Creek to allow encroachment of 5 feet into the PUD
common open space for construction of a three season porch of 12 feet by 14
feet for property located at 4064 Quantico Lane, subject to the following
findings and conditions:
1. No other amendments are granted or implied.
2. All applicable requirements of the City and State Building Codes shall be
implemented and enforced; no Code requirements are waived by this
approval.
3. The granting of the Conditional Use Permit amendment is responsive to
criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans
as specifically applied to this lot. The approval is based upon the
finding that there is a preexisting encroachment into the common area.
4. The easement from the Homeowners Association granting the right of
encroachment upon the common area (outlot) shall be recorded in a manner
approved by the City Attorney. Prior to issuance of a building permit for
the three season porch, evidence of the recorded easement shall be
submitted.
5. The porch may extend into the common open space only to the extent of the
existing deck encroachment.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Vasiliou , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Bergman, Councilmembers
Helliwell, Ricker, Vasiliou, and Zitur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
