Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 7th day
of May , 1990 The following members were present:
Mayor Bergman, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur
The following members were absent: None
Councilmember Vasiliou introduced the following Resolution and
moved its adoption:
RESOLUTION 90- 292
APPROVING SITE PLAN, CONDITIONAL USE PERMIT, AND VARIANCE FOR H.I.
ENTERPRISES, INC. (90015)
WHEREAS, H. I. Enterprises, Inc. has requested approval for a Site Plan,
Conditional Use Permit and variance for an auto repair/wash/gas facility and
convenience retail store for property located at the southeast corner of
Fernbrook and Harbor Lanes; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
H.I. Enterprises, Inc. for a Site Plan, Conditional Use Permit and variance
for property located at the southeast corner of Fernbrook and Harbor Lanes,
subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of building permit issuance.
4. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm
water drainage facility.
5. Submission of required financial guarantee and Site Performance Agreement
for completion of site improvements prior to issuance of the building
permit.
b. Any signage shall be in compliance with the Ordinance and the approved
Master Sign Plan of the Site Plan.
7. Any subsequent phases or expansions are subject to required reviews and
approvals p:r Ordinance provisions.
8. Compliance with the Ordinance regarding the location of fire hydrants and
fire lanes.

9. All waste and waste containers shall be stored within the enclosure, and
no outside storage is permitted.
10. An M x 11 inch "As Built" Fire Protection Plan shall be submitted prior
to the release or reduction of any site improvement bonds per City Policy.
11. No building permit to be issued until the rezoning ordinance is published
in the Official City Newspaper.
12. A Zoning Ordinance variance is approved to defer construction of 34 spaces
of the minimum required spaces for off-street parking, as shown on the
approved Site Plan, provided:
a. A covenant, prepared by the petitioner and approved by the City
Attorney, shall document the variance for deferred parking, the right
of the City, without further City Council action, to direct immediate
construction of the deferred parking on this site, and,
b. The covenant shall be recorded on the title to this property prior to
issuance of a building permit. The petitioner's acknowledgement that
failure to provide adequate lawful off-street parking and circulation
may be deemed grounds for revoking the Conditional Use Permit and may
limit the uses of the property.
13. The car wash shall include drying facilities that would be used on all
vehicles using the services of the car wash.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Zitur , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Bergman, Councilmembers

Whereupon the Resolution was declared duly passed and adopted.
