HomeMy WebLinkAboutCity Council Resolution 1990-290CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 7th day of May , 19 90 The following members were present: Mayor Bergman Councilmembers Helliwell Ricker Vasiliou- and 7irnr The following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION 90- 290 APPROVING SITE PLAN AMENDMENT, DEFERRAL OF OFFSTREET PARKING CONSTRUCTION, AND CONDITIONAL USE PERMIT FOR HOYT DEVELOPMENT COMPANY (90002) WHEREAS, Hoyt Development Company has requested approval for a Site Plan amendment, deferral of construction of required offstreet parking, and a Conditional Use Permit to allow for the office finish in the I-1 Zone of 65 percent gross floor area for property located at 13400 15th Avenue North; and, WHEREAS, a Site Plan has been administratively approved for this project by a letter dated November 9, 1989 under file 89075; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hoyt Development Company for a Site Plan amendment, deferral of construction of 55 offstreet parking spaces, and Conditional Use Permit to allow for the office finish for 65 percent gross floor area in the I-1 Zone for property located at 13400 15th Avenue North, subject to the following conditions: I. Compliance with the City Engineer's Memorandum. 2. Compliance with the conditions of the administrative approval letter dated November 9, 1989, related to project 89075. 3. Appropriate legal documents establishing a covenant on the property shall be approved by the City Attorney and filed at Hennepin County prior to issuance of the Conditional Use Permit and related building permits, identifying that the future uses of the building may require the construction of a parking ramp, as shown on plans on file with the City to provide the minimum parking for this building and approved uses. Further, the covenant shall recognize that parking deficiencies identified by City staff may require construction of the ramp to provide the minimum required parking and failure to provide the required parking will result in restrictions on the uses of the buildings. The parking require' is satisfied by lawful on-site parking facilities. The motion for adoption of the foregoing Resolution was duly seconded by Counrilmemhpr Ricker, and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell. Ricker, Vasiliou. and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
