HomeMy WebLinkAboutCity Council Resolution 1990-261CITY OF PLYMOUTH Pursuant to due call and notice thereof, arag»lar meeting of the City Council of the City of Plymouth, Minnesota, was held on the 16th day of April , 19-10-- The following members were present: Mayor Bergman. Councilmembers Helliwell Ricker, and Zitur The following members were absent: Councilmember Vasiliou Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION 90-261 APPROVING RPUD CONCEPT PLAN FOR LUNDGREN BROS. CONSTRUCTION COMPANY, INC. (90009) WHEREAS, Lundgren Bros. Construction Company, Inc. has requested approval of an RPUD Concept Plan for the creation of 113 single family lots and 4 outlots on 68.5 acres for property located north of County Road 24 and east of the municipal boundary; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Informational Meeting and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lundgren Bros. Construction Company, Inc. for an RPUD Concept Plan for the creation of 113 single family lots and 4 outlots on 68.5 acres for property located north of County Road 24 and east of the municipal boundary, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Staging of the development shall be in accordance with utility availability as approved by the City Engineer and based on a City contract for trunk construction. 3. Draft restrictive covenants for the private open areas (all proposed outlots) shall be submitted with Preliminary Plat/Plan application. 4. No private drive access shall be permitted to County Road 24; all private drives shall be provided by internal public streets. 5. The design of proposed private open space areas shall be specified with the Preliminary Plan. The approved improvements shall be installed prior to issuance of building permits for homes on the adjacent lots. (see next page) Resolution No. 90-261 File 90009 Page Two 6. The Preliminary Plat and Preliminary Plan shall designate the northeast corner of the site (depicted as Lots 1 and 14, Block 8) as a single outlot, the purpose of which is combination with land immediately to the north in the "Mitchell -Pearson Sketch Plan" at such time as the land to the north is platted to permit lotting design that best responds to the topography and wetland/woodland characteristics of this portion of the plat. 7. The RPUD residential development density is approved at 1.6 dwelling units per acre based on 68.5 acres site area above the 100 -Year flood elevation of the Plymouth Storm Water Drainage Plan. No density bonus points are assigned. 8. No variances are granted or implied. 9. The medians shown on the design plan should be retained for the entrance from County Road 24 only. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell , and upon vote being taken thereon, the following voted in favor thereof: Mayor sprgman F rnijnrilmPmhPrs Helliwell.
