V�a4-14-w+ The following members were absent: Non• Councilmember Vasiliou adoption: introduced the following Resolution and moved its RESOLUTION NO. 90-218 REVISING CONSTRUCTION COOPERATIVE AGREEMENT COUNTY ROAD 6, COUNTY PROJECT NO. 8642 FERNBROOK LANE TO COUNTY ROAD 101 CITY PROJECT NO. 829 WHEREAS, by Resolution No. 89-816 adopted December 18, 1989, the City Council approved the Construction Cooperative Agreement for the improvement of County State Aid Highway No. 6 from Fernbrook Lane to County Road 101; and WHEREAS, an error was made in that agreement when it was originally prepared by the County; and WHEREAS, that approval also contained the condition that the existing above ground utilities must be located underground in accordance with the Plymouth City Code; and WHEREAS, the County has requested changes in the City's approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the revised agreement (PW -15-17-90) is approved and the City's estimated cost share as contained within the agreement is revised from $943,942.40 to $1,221,785.06. FURTHER, that an additional $280,000 of City funding is provided for as contained within the original resolution. FURTHER, that the condition that the existing above ground utility lines be relocated in accordance with Section 735 of the Plymouth City Code be deleted from the City's approval. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Ricker , and upon vote being taken thereon, the following voted in favor thereof: Bergman, Vasiliou, Ricker, Zitur, Helliwell The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
