Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 19th day of
March , 1990. The following members were present: ,
Mayor Berman Councilmembers Helliwell- Ricker, Vasiliou. and 7iritr ,
The following members were absent: Bone
CoUncilmember Vasiliou introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 90-217
AUTHORIZING THE MAYOR AND CITY MANAGER TO ENTER INTO
AN EASEMENT AGREEMENT WITH THOMPSON LUMBER COMPANY
CITY PROJECT NO. 833
WHEREAS, the City of Plymouth has requested a street and utility easement from
Thompson Lumber Company in order to complete City Project No. 833; and
WHEREAS, Thompson Lumber Company has agreed to grant the easement providing
the City agree to compensate them and to restore in kind any landscaping
plants that are damaged as a result of construction; and
WHEREAS, said negotiated settlemer_t is in the best interest of the City.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the Mayor and City Manager are authorized to enter
into an agreement with Thompson Lumber Company guaranteeing that the City will
replace in like kind the shubbery and landscape vegetation that may be removed
in order to construct the project.
The motion for the adoption of the foregoing Resolution was duly seconded by
