HomeMy WebLinkAboutCity Council Resolution 1990-210CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19th day Of March , 19-2_Q, The following members were present: Magor Reraman- Goun ilmemhers Helliwell Ricker Vasiliou and Zitur The following members were absent: None Co mcilm mh r Vaa liou introduced the following Resolution and moved its adoption: RESOLUTION 90- 210 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO RPUD FINAL PLAT FOR LYMAN LUMBER COMPANY FOR PARKVIEW RIDGE (88018) (RPUD 88-3) WHEREAS, the City Council has approved the RPUD Final Plat and Development Contract for Lyman Lumber Company for Parkview Ridge located south of Rockford Road at Minnesota Lane; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: I. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and according to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. 4. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Appropriate legal documents regarding Homeowner Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. 8. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. (see next page) Resolution No. 90-210 File 88018 Page Two 9. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County Ordinance. 10. An access drive off County Road 9 shall be provided for construction vehicles, and all construction traffic shall access the property from County Road 9, until the first home is certified for occupancy. A barricade shall be constructed and maintained on 38th Avenue and on 39th Avenue at the plat boundary until the first dwelling is certified for occupancy. 11. No private drive access shall be permitted to County Road 9; all private drives shall be provided by internal public streets. 12. The private trails shall be built to City standards and shall be constructed prior to issuance of building permits for homes on lots adjacent to the trails; an exception may be made for Lots 1, 2, and 3, Block 3; and Lots 3 and 4, Block 2, where model homes may be built, but not occupied, until the adjacent trails are constructed. 13. The design on proposed private open space areas including tot lots is specified. The approved improvements and equipment shall be installed prior to issuance of building permits for homes on the adjacent lots. 14. Outlots A and F shall be deeded to the City prior to filing the Final Plat with Hennepin County. 15. Minimum yard setbacks shall be 30 feet for the front yards (detached and attached) except Lots 1 and 2, Block 1, and Lots 8, 9, and 10, Block 3, which shall be 25 feet; 10 feet for the side yards; and 15 feet for the rear yard. Structure setback to Outlot A on Lot 1, Block 2, shall be 30 feet. 16. The developer w?11 provide copies of the current overall PUD Plan and its current conditions as an addendum to their Purchase Agreement. 17. Subsequent phases shall be subject to Ordinance provisions for Plan and Plat applications for the review and approval. 18. The Development Contract as apN;nved by the City Council shall be Fully executed prior to release of the Finn' Plat. 19. Lots 1 and 2, Block 2, may have model homes built, but not occupied, prior to construction on trails on adjacent outlots or easements. The Development Contract (paragraph 14.14) shall be amended accordingly. (see next page) . Resolution No. 90-210 File 88018 Page Three 20. Subject to the receipt of a proper permit from the Hennepin County Department of Public Works, the public trail to be constructed parallel to Rockford Road east of Minnesota Lane may be constructed in the right-of- way of Rockford Road. If this location option is selected and approved, the easements required for trail purposes per paragraph 10 of the Engineer's Memorandum of September 20, 1980, will not be required. 21. Resolution 89-601 and Resolution 89-602 are hereby null and void. The motion for adoption of the foregoing Resolution was duly seconded by councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bgrgman, Caunrilmamherc _ Helliwell, Ricker, Vasiliou and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
