HomeMy WebLinkAboutCity Council Resolution 1990-206CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19 th day of March , 19-2q__ The following members were present: Mayor Bergman. Couniilmembers Helliwell. Ricker Vasiliou and Zitur The following members were absent: None -Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION 90-206 SETTING CONDITIONS TO BE MET KIOR TO FILING OF AND RELATED TO FINAL PLAT FOR MADPATT ENTERPRISES FOR FISCHERS POND (89039) WHEREAS, the City Council has approved the Final Plat and Development Contract for Madpatt Enterprises for Fischers Pond located east of County Highway 101 at 30th Avenue North: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time at issuance of building permit. 3. Removal of all dead or dying trees from the property at the owner's expense. 4. Removal of existing structures at the developer's expense, except that the dwelling unit on Lot 5, Block 1, shall be permitted to remain until October 31, 1990. The developer shall enter into a Site Improvement Performance Agreement and provide performance security in the amount of $10,000 to assure compliance with this provision before November 30, 1990; and building permits on adjoning Lots 1 and 6, Block 1, shall not be issued until all structures, including the dwelling on Lot 5, are removed. The Development Contract shall be amended to comply with this condition. No building permits shall be issued within this plat prior to recording of the Site Improvement Performance Agreement as an encumbrance on Lot 5, Block 1. 5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. No yard setback variances are granted or implied. (see next page) Resolution No. 90-206 File 89039 Page Two 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 8. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 9. Access shall be limited to internal public roads and prohibited from County Road 101. 10. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. 11. Compliance with the provisions of City Council Resolution 89-439 regarding tree preservation. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
