HomeMy WebLinkAboutCity Council Resolution 1990-201CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19th day of March , 19-19— The following members were present: Mayor Berman Councilmembers Helliwell Ricker Vasiliouand Zi ur The following members were absent: None councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION 90-201 APPROVING CONDITIONAL USE PERMIT FOR RICHARD WHITING FOR AN AMATEUR RADIO ANTENNA AT 5780 ROSEWOOD LANE (89104) WHEREAS, Richard Whiting has requested approval of a Conditional Use Permit to locate an amateur radio antenna in excess of R-2 Zoning District maximum height standard at 5780 Rosewood Lane; and, WHEREAS, the PlaAning Commission has reviewed said request at a duly called Public Hearing ani has recommended approval; NOW, THEREFORE, BE 11 YEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Richard Whiting to locate an amateur radio antenna in excess of R-2 Zoning District height standard of 35 feet at 5780 Rosewood Lane, subject to the following conditions: 1. The permit is issued to the petitioner/tenant as operator of the facility and shall not be transferable. 2. No signage shall be permitted on the tower. 3. The permit is subject to all applicable codes, regulations, and Ordinances, and violation thereof shall be grounds for revocation. 4. The permit shall be reviewed annually to assure compliance with the conditions imposed and monitor incidences of interference with neighborhood radio/television reception. 5. Maximum tower height approved is 60 feet, plus mastings height to a maximum of 15 additional feet. 6. Tower location shall be modified so that the total tower height would be contained within the applicant's property if the tower were laid perpendicular to the ground; or an indemnity agreement shall be submitted to the City of Plymouth, holding the City of Plymouth harmless with respect to damages and/or injurious resulting from a failure of the antenna structure. Resolution No. 90-201 Page Two File 89104 7. The design of the antenna itself shall be revised so that the array shall have four elements rather than seven. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell , and upon vote being taken thereon, the following voted in favor thereof: Major Bergman, Councilmembers Helliwell, Ricker, and Zitur The following voted against or abstained Councilmember Vasiliou Whereupon the Resolution was declared duly passed and adopted.
