HomeMy WebLinkAboutCity Council Resolution 1990-180CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 26th day of February , 1990. The following members were present:Ppgaman.Helliwell-eur The following members were absent: None Councilmember vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-180 MODIFICATION OF PAYMENT SCHEDULE LEVY NOS. 11127 AND 11129 WHEREAS, pursuant to adoption of Resolution No. 88-467 and Resolution No. 88-466 special assessments were levied by the City Council for Project No. 544, Fernbrook Lane North of Co. Rd. 9 for Street and Utility Improvements and Sewer and Water Area Assessments; and WHEREAS, the owners of Parcel 15-118-22-22-0006 appealed the special assessments and the City Attorney and property owners have reached an agreement on a settlement of the appeal; and WHEREAS, it is recommended that the City of Plymouth modify the assessment roll and the property owners will withdraw their special assessment appeal; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the amounts of the levy of assessments for Project No. 544 as they apply to Parcel 15-118-22-22-0006 remain as fixed in Resolution No. 88-467 and Resolution No. 88-466 as follows: Sewer and Total Street Watermain Water Area Assessment $64,845.00 $14,770.80 $12,515.60 $92,131.40 Resolution No. 90-180 Page 2 2. That the following portions of the levy of assessments shall be spread in accordance with the terms of Levy No. 11127: Total Assessment Street Watermain Currently Payable $9,271.35 $3,073.95 $13,015.30 3. That the following portions of the levy of assessments shall be spread in accordance with the terms of Levy No. 11129: Sewer and Water Area $670.00 4. That payment of the balance of the levy of assessments be deferred until such time as the City Council of the City of Plymouth grants final approval to a subdivision plat for Parcel No. 15-118-22-22-0006 or until August 15, 2008, whichever occurs first: Total Deferred Street Watermain Water Area Assessment $55,573.65 $11,696.85 $11,845.60 $79,116.10 5. That interest on the unpaid principal balance of the deferred assessments shall accrue at the annual rate of eight percent beginning August 15, 1988. 6. That when the deferred assessments become payable, the unpaid principal balance of the deferred assessments plus accrued interest shall be spread over a five year period at eight percent annual interest beginning on the date on which the deferred assessments become payable. 7. If Parcel No. 15-118-22-22-0006 is developed before all installments of the deferred assessments have been paid, the deferred assessments will be reassessed according to the terms of the Agreement between the City of Plymouth and Lillian A. Begin, Kevin C. Begin, Jacqueline Begin, and Lawrence H. Begin dated January 26 , 1990. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember� Zitur. _ , and upon vote being taken thereon, the following voted in favor thereof: Mayor Berman Councilmembers Helliwell Rickeryagilinu and 7+f iir The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
