HomeMy WebLinkAboutCity Council Resolution 1990-143CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 26th day of E b =, 19_91L_ The following members were present: Mayor Ser man_. councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Cn�nrilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION 90-143 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO THE MPUD FINAL PLAT FOR KEVIN KUECHLE (89033) (MPUD 83-1) WHEREAS, the City Council has approved the MPUD Final Plat and Development Contract for Kevin Kuechle for the "Kuechle Addition" located at the northeast corner of Terraceview Lane and 9th Avenue North; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 3. Removal of all dead or dying trees from the property at the owner's expense. 4. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 5. No yard setback variances are granted or implied. 6. Approved setbacks are: 35 feet front, 15 feet side, and 25 feet rear. 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 8. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 9. The Final Plat mylars shall contain a statement noting that the plat is part of the approved MPUD 83-1 per S, tion 9 of the Zoning Ordinance. (see next page) Resolution No. 90-143 File 89033 Page Two 10. Access shall be limited to internal public roads and prohibited from: Shenandoah Lane. 11. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor gwn- CouncilmejWhers Helliwell, Ricker_ Vasiliou. and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
