HomeMy WebLinkAboutCity Council Resolution 1990-135CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 26th day of February 1990. The following members were present: Mayor Bergman, Councilmembers Rpiliwpll` Ricker, Vasiliou, and Zitur The following members were absent: None �nsn�ilmPmher Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-135 AUTHORIZING THE VACATION OF A PORTION OF ZIRCON LANE RIGHT OF WAY BETWEEN THE EASTERLY EXTENSION OF THE NORTH LINE OF LOT 1 BLOCK 11 GREENTREE WEST AND THE SOUTH PLAT LINE OF GREENTREE WEST FOR BAY POINTE ON MOONEY LAKE ADDITION WHEREAS, a petition was received to vacate a certain right of way in Greentree West Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for February 26, 1990 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of February 26, 1990 and WHEREAS, the Council did hold a public hearing on February 26, 1990 to inform any and all interested parties relevant to the vacation of a portion of Zircon Lane in Greentree West Addition; and 10 WHEREAS, it was determined by the City Council that said right-of-way is not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following right-of-way be vacated: That part of Zircon Lane right-of-way between the easterly extension of the north line of Lot 1, Block 11, Greentree West and the south plat line of Greentree West, according to the recorded plat thereof. FURTHER, that City shall reserve a drainage and utility easement for the existing watermain, sanitary sewer and storm sewer over all of said vacated street. FURTHER, that said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipers, mains and hydrants thereon or thereunder, to continue maintaining the same, to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attend thereto. FURTHER, the City shall reserve a trail easement over the east 30 feet of said vacated street. The motion for the adoption of the foregoing Resolution was duly seconded by Magnr Aprgman , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman. Councilmembers Helliwell, Ricker, Vasiliou, and 71 t„ r The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
