HomeMy WebLinkAboutCity Council Resolution 1990-132CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 26th day of February , 1990. The following members were present: Mayor Bergman. Councilme hers Helliwell. , Rirkpr- 71tur_and Sisk The following members were absent: None Councilmemher ilaSiliou _ introduced the following Resolution and moved its adoption: RESOLUTION NO. 90-132 AUTHORIZING THE VACATION OF A DRIVEWAY EASEMENT IN BLOCK 2 SCHERER INDUSTRIAL DEVELOPMENT ADDITION WHEREAS, a petition was received to vacate a driveway easement in Block 2 Scherer Industrial Development Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for February 26, 1990 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of February 26, 1990 and WHEREAS, the Council did hold a public hearing on February 26, 1990 to inform any and all interested parties relevant to the vacation of a driveway easement in Block 2 Scherer Industrial Development Addition; and WHEREAS, it was determined by the City Council that said easement is no longer needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following driveway easement be vacated: The west 15.00 feet of the east 226.18 feet of Block 2, Scherer Industrial Development, according to the recorded plat thereof, except the north 35.00 feet thereof. and The west 15.00 feet of the east 241.18 feet of Block 2, Scherer Industrial Development, according to the recorded plat thereof, except north 35.00 feet thereof. and That part of Block 2, Scherer Industrial Development, according to the recorded plat thereof, lying 15.00 feet on each side of the following described line: Commencing at the northeast corner of said Block 2; thence on an assumed bearing on North 89 degrees 03 minutes 04 seconds west 226.18 feet; thence South 01 degrees 14 minutes 52 seconds East 50.00 feet to the beginning of said line; thence North 89 degrees 03 minutes 04 seconds West 171.00 feet; thence South 20 degrees 56 minutes 56 seconds West 121.00 feet; thence South 55 degrees 26 minutes 32 seconds West 128.12 feet to the intersection with the centerline of Nathan Lane and said line there terminating. The motion for the adoption of the foregoing Resolution was duly seconded by rnuncilmpmhpr 2itur , and upon vote being taken thereon, the following voted 10 in favor thereof: _Mayer Bergman. Councilmembers Helliwell. Ricker, Vasiliou, and 71 rrnr The following voted against or abstained: _None Whereupon the Resolution was declared duly passed and adopted.
