HomeMy WebLinkAboutCity Council Resolution 1990-085CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 5th day of February , 1990. The following members were present: , Mayor Bergman, Councilmembers Helliwell_ Ricker_ Vasillou- and 7irn r , The following members were absent: None Councilmember 2.itur introduced the following Resolution and moved its adoption: RESOLUTION NO. 90- 85 ORDERING PUBLIC HEARING ON THE PROPOSED VACATION OF A STORM SEWER EASEMENT AND SURFACE DRAINAGE EASEMENT OVER A PORTION OF GOVERNMENT T.OT 1, SECTION 30 FOR BAY POINTE ADDITION WHEREAS, pursuant to M.S.A. 412.851, the developer of the proposed plat of Bay Pointe on Mooney Lake has petitioned the City Council for the vacation of the following storm sewer easement and surface drainage easement within a portion of Government Lot 1, Section 30, Township 118. DESCRIPTION OF PARCEL: That part of Government Lot 1, Section 30, Township 118, Range 22 described as follows: Commencing at the northwest corner of said Government Lot 1; thence east along the north line of said Government Lot 1, a distance of 80 rods; thence south a distance of 78 rods; thence west to the shore of Lake Mooney; thence along the shore of said lake to the west line of said Government Lot 1; thence north along the west line of said Government Lot 1 to the point of beginning and there terminating. DESCRIPTION OF EASEMENT: A 64 foot wide permanent easement for storm sewer and surface drainage purposes over, under, across and through part of the afore -described parcel. The centerline of said easement being as follows: Commencing at the northwest corner of the afore - described parcel; thence east along the north line of said parcel for a distance of 664.05 feet to the actual point of beginning of the centerline to be described; thence deflecting to the right 91 degrees 35 minutes for a distance of 22.0 feet; thence deflecting to the left 40 degrees, 00 minutes for a distance of 230.0 feet; thence deflecting to the left 20 degrees 00 minutes for a distance of 270.0 feet; thence deflecting to the right 54 degrees 00 minutes for a distance of 275.0 feet; thence deflecting to the left 21 degrees 00 minutes to the shoreline of Mooney Lake and there terminating. . AND, WHEREAS, the City Council has reviewed said request and found the same to be in order, Resolution No. 90- 85 Page Two NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That it should, and hereby does, establish the date of February 26, 1990 at 7:00 p.m. in the Council Chambers, Plymouth City Center, 3400 Plymouth Boulevard, as the time and place for the public hearing of said petition and directs the administrative staff to publish notice of said hearing as provided by law. The motion for the adoption of the foregoing Resolution was duly seconded by Crnincilmemher Ricker , and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman- Cnuncilmemherc Helliwell.
