Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the sth day
of ebruary, 19_2_0 The following members were present:
Mayor_Be_rgman,Co_uncilmembers Helliwell, Ricker. Vasiliou, and Zitur
The following members were absent: atone
Councilmember Vasiliou introduced the following Resolution and
moved its adoption:
RESOLUTION 90-74
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
LOWRY HILL CONSTRUCTION COMPANY (89105) (RPUD 81-4)
WHEREAS, the City Council has approved the Final Mat and Development Contract
for Lowry Hill Construction Company for "Deerhaven Third Addition" located at
the southwest corner of 57th Avenue North and Zachary Lane;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. No Building Permits shall be issued until a Contract has been awarded for
the construction of municipal sewer and edater.
3. Removal of all dead or dying trees from the property at the owner's
expense.
4. Compliance with Policy Resolution I4o. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
S. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
6. No Building Permits to be issued until the Final Plat is Vied and
recorded with Hennepin County.
7. Appropriate legal documents regarding Homeowner Association covenants and
restrictions as approved by the City Attorney, shall be filed with the
Final Plat.
8. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 81-4 per Section 9 of the Zoning Ordinance.
9. Access shall be limited to internal public roads and prohibited from
Zachary Lane.

10. The Development Contract as approved by the City Council shall be fully
eMecuted prior to release of the Final Plat.
11. Ompliance with applicable terms anO conditions of City Council Resolution
82-268 (approving the PUD Final Plan/Final Plat Conditions Prior to Filing
Related to "Deerhaven Second Addition") and applicable provisions of the
Development Contract for Deerhaven Addition executed January 25, 1982.
The motion for adoption of the foregoing Resolution was duly seconded
by Mayor Bergman , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Bergman, Councilmembers
Helliwell, Ricker, Vasiliou, and Zitur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
