HomeMy WebLinkAboutCity Council Resolution 1968-216EXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF PLYMOUTH, MINNESOTA Pursuant to due call and notice thereof, a swgwtan - special meeting of the Village Council of the Village of Plymouth was held on the 19th day of September , 19 68 , commencing at 7:30 o'clock P.M. at the Village Hall, 13800 State Highway #55. The following members were present: Mayor Hilde, Councilmen O'Pallon and Hagen. the following members were absent: Councilmen Hunt and Humphrey. a a a a a a a a a Councilman Hagen introduced the following resolution and moved its iadoption: 'RESOLUTION NO. 68-216' A RESOLUTION CCt1FIRMING AND ADOPTING THE ASSESSMENT FOR KINGSVIEW..LANE SANITARY SEWER PROJECT WHEREAS, pursuant to due and proper notice according to law an assessment hearing was held on the 19th day of September, 1968, relating to Kingsview Lane Sanitary Sewer Project and, WHEREAS, all persons present desiring to be beard were hoard and their objections, Of any, were noted NOW, THEREFORE, BE IT HEREHr RESOLVED BY THE VILLAGE COUNCIL OE THE VILLAGE OF PLYMOUTH, MINNESOTA, AS FOLLOWS: 1*1. The village Clerk has, with the assistance of the Village engineers heretofore selected by this council for such purpose, calculated the proper amounts to be specially assessed for Kingsview Lane Sanitary Sewer Project against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same, 2. Notice has been duly published as required by law that this council would meet in regular session at this time and place to pass on the • proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and two objections have been filed. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of Kingsview Lane Sanitary Sewer Project in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. S. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for Kingsview Lane Sanitary Sewer Project 7. The amounts assessed against each lot, piece or parcel of land shall bene interest from the date hereof until the same have been paid at the rate of six percent per annum. S. Such assessments shall be payable in 30 equal annual installments payable on the let day of January in each year, beginning in the year 19 69 , and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 19 68 , To each subsequent installment shall be added interest for one year on all unpaid installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County -Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the let day of January in each year." The above motion was seconded by Councilman O'Fallon and upon vote being taken thereon, the following voted in favor thereof Mayor Hilda, Councilmen O'Pallon and Hagen. the following .toted againsto None. VILLAGE OF PLYHOUM) 1, the undersigned, being the duly qualified and acting clerk of the Village of Plymouth, Minnesota, hereby certi:Ly that I have carefully compared the attached and foregoing extract of minutes of a (regular) (special) meeting of the Village Council of said village held September 19th , 19 68 , with the original thereof on file in my office and the same is a full, true and complete transcript therefrom insofar as the same relates to adoption of assessment for Kingsview Lane Sanitary Sewer Project.
