Village Council of the Village of Plymouth was held on the 19th day of
September , 19 68 , conmencing at 7:30 o'clock P.M. at the Village
Hall, 13800 State Highway #55.
The following members were present: Mayor Hilde, Councilmen O'Fallon and
Hagen.
the following members were absent: Councilmen Hunt and Humphrey.

Councilman Hagen introduced the following resolution and moved its
adoption:
'tRESOLUTION NO. 68-215"
A RESOLUTION CONFIRMING AND ADOPTING
THE ASSESSMENT FOR
34TH AVENUE SANITARY SEWER AND WATER PROJECT
WHEREAS, pursuant to due and proper notice according to law an assessment
hearing was held on the 19th day of September, 19689
relating to 34th Avenue Sanitary Sewer and Water Project
and,
WHEREAS, all persons present desiring to be heard were heard and their objections,
0 if any, were noted
NOW, THEREFr)RE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VIIIAGE OF
PLYMOUTH, I4INNESOTA, AS FOLLOWS:
"l. The Village Clerk has, with the assistance of the Village
engineers heretofore selected by this council for such purpose, calculated
the proper amounts to be specially assessed for 34th Avenue Sanitary Sewer
and Water Project
against every assessable lot, piece or parcel of land, in accordance
with the provisions of law, and has prepared and filed in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece or parcel of land to be specially assessed
in the amount calculated against the same,
2. Notice has been duly published as required by law that this council
would meet in regular session at this time and place to pass on the
• proposed assessment.
3. The proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to present their objections,
if any, to such proposed assessment, or to any item thereof, and
no objections have been filed.
4. This council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment was and is specially benefited
by the construction of 34th Avenue Sanitary Sewer and Water Project
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
S. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shall thereupon be
and constitute the special assessment for 34th Avenue Sanitary Sewer
and Water Project
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate of six percent per annum.
S. Such assessments shall he payable in 30 equal annual installments
payable on the let day of January in each year, beginning in the year
19 69 , and continuing until all of said installments shall have been
paid, each installment to be collected with taxes collectable during
said year by the County Auditor. To the first installment shall be
added interest on the entire assessment from the date hereof to
December 31, 19 68 , To each subsequent installment shall be added
interest for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file in the office
of the County Auditor of Hennepin County a certified statement of the
amount of all of such unpaid assessments and the amount which will be
due thereon on the lot day of January in each year."
The above motion was seconded by Councilman O'Fallon and upon vote being
taken thereon, the following voted in favor thersoft Mayor Hilda, Councilmen
O'Fallon and Hagen

whereupon said resolution was declared duly .passed and adopted.

I, the undersigned, being the duly qualified and acting clerk of the
Village of Plymouth, Minnesota, hereby certify that I have carefully compared
the attached and foregoing extract of minutes of a (regular) (special) meeting
of the VD lage Council of said village held September 19 , 19 68 , with
the original thereof on file in my office and the same is a full, trus and
complete transcript therefrom insofar as the same relates to
the adoption of the assessment for 34th Avenue Sanitary Sewer and Water Pro#qct.
