SPIN VILLAGE OF PLYMOUTH 7S%1 Z1ORARY IM 0V8 F BOND OF 1968 $100,000 KNOW ALL ° BY ThTSE PRESENTS That the Village of Plymouth, a duly organized municipal corporation of Hennepin County, Min- nesota, acknowledges itself to be indebted and, for value received, promises to pay from its Construction Fund For Public Improvement Bonds of 1968 the sun of 0?v'E W.i-Aonnii THO—k SAND DOLLARS on the 1St day of November, 1968, with option of prior payment, and to pay interest thereon from the date hereof until paid at the rate of three and one-half percent (3�Y%) per annum, payable the 1st day of November, 1968. Both principal and interest are payable at First Natio nal Bank of Minneapolis, Minneapolis, Minnesota, in any► c )in or currency of the Un..ted States o: 6marica which at the time of payment is legal tender for public and private debts. For the prompt and full payment of such principal and interest as the same become due, the full faith, credit and taxing powers of the village ; are hereby irrevocably pledged. This bond is in the aggregara principal amount of $100,000,' issued by said village for the purpose of defraying expenses in- curred and to be incurred i:a the construction of public improve- ments of the village and is issued pursuant to and in full con- formity with the Constitution and :a s of the State of Minnesota thereunto enabling, including Minnesota Statutes, Section 429.091, Subdivision 3_ This bond is payable primarily from the proceeds of special assessments to be levied by the village against property benefited by the making of such improvements but constitutes a •, general obligation of the village; and the village is required to Pay the principal thereof and interest thereon from any funds in the treasury in the event the moneys on hand in said Construction Fund are at any time insufficient to pay principal and interest on bonds of this issue, when due, and, at or prior to maturity of this bond, the village is further required to issue and sell definitive improvement bonds and to pay this bond and interest thereon out of the proceeds of such definitive improvement bonds, to the extent that this bond cannot be paid out of assessments and taxes theretofore collected or out of any other municipal funds which are properly available and appropriated by the village for such purpose. IT IS HEREBY CERTIFIED, RECITED, COVENANTED AND AGREED y That all acts, conditions and things required by the Constitu- tion and laws of the State of Minnesota to be done, to happen and to be performed preliminary to and in the issuance of this bond in order to make it a valid and binding obligation of the village according to its terms, have been done, do exist, have happened and have been performed as so required; that the village has duly determined the necessity of and provided for the con- struction of said improvement; that the Construct -on fund has been duly created and provision has been made for support thereof by ad valorem taxes and special assessments to be levied, at or prior to the time for issuance of such definitive bonds, for the years and in aggregate amounts not less than five percent (5%) in excess of sums sufficient tD pay the principal and interest becomo due, and additional taxes, if needed for said purpose, may be levied upon all taxable property in the village without limitation as to rate or amount; that the holder hereof may have and enforce by appropriate proeeedi n g*s all duties imposed by Minnesota Statutes, Chapter 429, upon the village and its officers with reference to the levv and collection of said assess- monts and taxes and the issuance of said definitive bonds; and that the issuance of this bond did not cause the indebtedness, of said village to exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the Village of Plymouth, Hennepin County, Minnesota, by its Village Council, has caused this bond to be executed in its behalf by the manual signature of its Mayor and the manual signature of its Clerk, and sealed with its imprinted and facsimile official seal, and has caused this bond to be dated as of August (a , 1968. Y 7. The village clerk shall obtain a copy of the proposed approving legal opinion of Messrs. Howard, LeFevere, Lefler, Hamilton and Pearson, which shall be complete except as to dat-ng thereof. The clerk shall obtain a copy of the opinion at the time of bond delivery and execute a separate certificate as to such opinion in his office. S. The bond shall be prepared under the direction of the village clerk and shall be executed on behalf of the village by the manual signature of the mayor and the manual signature of the clerk, and the corporate seal of the village shall be affixed thereto. When said bond has been executed and authen- ticated, it shall be delivered by the treasurer to the purchaser thereof, upon payment of the purchase price heretofore agreed upon, and said purchaser shall not be obligated to see to the application thereof. 9. The village clerk is hereby authorized and directed to file a certified copy of this resolution with the county auditor of Hennepin County, together with such other in- formation as he shall require, and to obtain from said county,, auditor a certificate that said bond has been entered on his bond register. The above motion was seconded by Councilman Humphrey and upon vote being taken thereon the following voted in favor thereof: Mayor Hilde, Councilmen O'Falloa, Hagen, Hunt and Humphrey.
