HomeMy WebLinkAboutCity Council Resolution 1968-066Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Plymouth was hold at the Village Hall on April 1, 1968 commencing at 7:30 o'clock p.m. 4 GtfS The following members were present: Mayor Hilde, Councilmen } O'Fallon, Hunt, Hagen and Humphrey. The follow_ng members were absent: None. Cnunci than ?'ascan introduced the following resolution and moved its adoption: f "RESOLUTION NO 68-66 A RESOLUTION AUTHORIZING THE MAYOR TO SIGN THE ORDER O: SUSPENSION AND NOTICE OF HEARING AND CHARGES AGAINST CLATIDE D. LIEN, CHIEF OF POLICE WHEREAS, at the direction of the Village Council the Village Attorney has investigated the conduct of Claude D. Lien' as Chief of Police of Plymouth Village, and WHEREAS, as a result of such investigation the Village Attorn©y has presented to the Council a draft of charges against said Claude D. Lien, and WHEREAS, said charges have been reviewed and studied by said Village Council, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLI^.Oii:H AS FOLLOWS: 1. That the Mayor be authorized and directed to execute on behalf of the `.'illagc of Plymouth the Order of Suspension and Notice of Ilearing and the charges 21, s Village of alymo# h, Minnesota { 2. That in accordance with said Order of Suspension and Notice of hearing said Claude D. Lion i, ' hereby suspended as Chief of Police of the Village of Plymouth and as a member of the Plymouth Police Department with pay pending the outcome of the hoarin; on such charges. 3. That the Clark-Administrator is directed to deliver to said Claude D. Lien an executed copy of the Order of Suspension and Notice of Hearing and the written% charges." The above motion was secoc:ded by Councilrmn n'i'•tllon rw and upon vote being taken thereon the following voted in favor thereof: F Mayor 11ilde, Councilmen O'Fallon, Hunt, Hagen and Humphrey. VILLAGE OF PLYMOUTH) I, the undersigned, being he duly qualified and actin,- Clerk-Administrator of the :Tillage of Plymouth, Minnesota, hereby certify that I have carefully compared the attached and foregoing extract of minutes of a regular meeting of the Village Council of said village held April 1, 1938, with the original thereof on file in my office and the same is a full, true and complete transcript therefrom insofar as the same relates to authorizing the Mayor to sign the Order of Suspension and Notice of Hearing and Charges against Claude D. Lien, Chief of Police NOTICE OF HEARING TO: Claude D. Lien, Chief of Police, Plymouth, Minnesota Please take notice that you are hereby suspended with pay from your position and post of Chief of Police of Plymouth, Minnesota, pending the hearing.of charges made against you, a copy of which charges is attached hereto and is hereby served upon you. You will further please'take notice that a hearing for the purpose of investigating such charges will be held by a s Board of three (3) persons to be hereafter selected as follows. One (1) member thereof to be selected by yourself, One'(1) member to be selected by the Village Council of the Village of Plymouth and One (1) member,to be selected by the first two so chosen. In the event the first two selected are unable to agree, the third such member shall be selected by a Judge of the Hennepin County District Court. The date and place of such hearing shall be determined by the .members of the Board so selected. You are requested to submit the name of your selection to such Board to the Mayor of the Village of Plymouth. Please be advised that youareentitled to be present at such hearing in person or by counsel, or both, and to be heard and to present evidence in your own behalf.
