Pursuant to due call and notice thereof, a SOON$= - special meeting of the
Village Council of the village of Plymouth was held on the 422 day of

RESOLUTION NO. 67.171
A RESOLUTION CONFIRMING AND ADOPTING
THE ASSESSMENT FOR

WHEREAS, pursuant to due and proper notice according to law an assessment
hearing was held on the 40 407 of OeftbM, 1967#

WHEREAS, all persons present desiring to be heard were heard and their objections,
if any, were noted
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
PLYMOUTH, MINNESOTA, AS FOLLOWS:
"1. The village Clerk has, with thw assistance of the T Te+edoww

the proper amounts to be specially assessed for avow %t project.
against every assessable lot, piece or parcel of L,nd, in accordance
with the provisions of law, and has prepared and filed .in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece or parcel of land to be specially assessed
in the anount calculated against the same,
2. Notice has been duly published as required by law that this council
would meet in regular session at this time and place to pass on the
proposed assessment.

• 3. The proposed assessment has at all times since its tiling been open to
inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to p,-estnt their objections,
if any, to such proposed assessment, or to ary item thereof, and
no objections have been filed.
4. This Council finds that each of the lots, pieces or _arcels of land
enumerated in said proposed assessment was and is specially benefited
by the construction of 36th Avenue Improvement Project
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
5. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively,
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shall thereupon be
and constitute the special assessment for 36th Avenue Improvement Project.
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same haus been paid at
the rate of six percent per annum.
S. Such assessments shall be payable in 5 equal annual installments
payable on the 1st day of January in each year, beginning in the yc-r
19 68 , and continuing until all of said installments shall have been
paid, each installment to be collected with taxes collectable during
said year by the County Auditor. To the first installment shall be
added interest on the entita assessment from the date hereof to
December 31, 19 67 , To each subsequent installment shall be added
interest for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file in the office
of the County huditor of Hennepin County a certified statement of the
• amount of all of such unpaid assessments and the amount which will be
due thereon on the 1st deny of January in each year."
The above motion was seconded by Councilman Hagen and upon vote being
taken thereon, tLie following voted in favor thereof: Mayor Staples, Councilmen
O'Fallon, Hagen and Hunt.

Whereupon said resolution was declared duly passed and adopted.
