The ioll.owing members were present: Mayor Staples, Councilmen O' Ffxil+gin, Fagen and Hunt. the follc.Ing weribers were absent: None. s � s * * s a * • . ilmar.1b= introduced the following resolution and moved its adaption: RESOLUTION NO, 67-164 A RESOLUTION CONFIRMING AND ATIOPTING THS ASSESSMENT FOR CREE1<W00D HEIGHTS STREET LIGHTING WHEREAS, pursuant to due and proper notice according to law an assessment hearing was held on the 2nd day of October, 1967, relating to charges for street lighting operation for Creekwood Heights and other adjacent areas described in the notice of assessment hearing and, WHEREAS, all persons present desiring to be heard were heard and their objections, if any, were noted, NOW, THRRXF=, BE IT BEREDY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTB, MINNESOTA AS FOLLOWS: • 0 "l. The Village Clerk has, with the assistance of the Village Treasurer calculated the proper amounts to be specially assessed for street lighting in rreekwood Heights and other adjacent areas descriued in the notice of assessment hearing against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has pre- pared and filed in his office tabulated statements in dupli;ate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against same. 2. Notice has been duly published as required by law that this council would meet in regular session at this time and Mace to pass on the proposed wmsessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed. 4. This Council finds that each of the lots, pieces or par- cels of land enumerated in said proposed assessment was and is specially benefited by the construction of such street lighting In the amount in said proposed assessment sot opposite the description. of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5. Such proposed assessment is affirmed, adopted and con- firmed, and the sums fined and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for street lighting for Creekwood Heights and other areas adjacent as described in the notice of assessment hearing. 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of o percent per annum. S. Such assessment shall be payable in one equal annual Installments payable on the lot day of January in each Year, beginning in the year 19 6a and continuing until all of said installments shali-%M61 been paid, each installment to be collected with taxes collectible daring said year by the County Auditor. To the first Installment shall be added interest on the entire assess- ment from the date hereof to December 31, 19 67. To each subsequent installment shall be added intereiifor one Year on all unpaid installments. -2- 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennein County a certified statement of the amount of alf of such unpaid assessmsnts and the amount which Will be dus thereon: on the Ist day of January in oach year. The above motion Was seconded by Mayor staples and upon vote being taken thereon, the following voted in favor thereof; Mayor Staples, councilmen O'Fallon, Duntley, Hagen and Hunt. the following voted against: None.
