U. The following members Were present: Mayor Staples, Councilmen O'Fallon and t Hunt; and the following members were absent: Councilmen Huntley and Hagen. s•a r•r s*e I Mayor Staples introduced the following resolution aced moved its adoption: "Resrlutiam No. 67-181 � A RRSMUTI(W AVMRIZUG TIM EXERCISE OF TO RIGHT Or EXINNNT DONAIN KITH RESPECT TO CERTAIN LANDS IN GDV11Un ENT LOT 4, IN SECTION 25, TOWNSHIP 118, RUM 22 WHEREAS, it has been deemed by the Village Council to be necessary and desirable that easements be acquired by i the Village for street, sanitary sealer, water and general i' utility purposes over and &aroma a portion of Government Lot 4, j !j Section 25, Township 115, Range 22 and, WHEREAS, pursuant to Chapter 429 Minnesota Statutes, proceedings have been commenced to effect a public improvement f for such purposes over such property and, WHSUAS, pursuant to such proceedings a contract has been let for the construction of a street and the inst..11a- tion of sanitary &ewer and water mains over said premises, NOW, T>I$ , BE IT HSRIMY RESOLVED BY THR V ILUGE COUNCIL OF THE VILLAGE OF PLYMOUTH AS MLWWS: 1. That the Village Attorney be authorized and directed to acquire by eminent domain proceedings a permanent easement for street, sanitary surer, water and general utility purposes over and across a strip of land 80 feet in width the center line of which is described as follows: That part of the Northeast 1/4 of the Norteeast 1/4 of Section 36, Township 118, North Range 22, Hest of the 3th Principal Meridian. Government Lot 4, Section 25, Township 118, Range 22 and Tract A, Registered Land Survey No. 921, Files of the Registrar of Titles, County of Hennepin, described as beginning at the Southeast corner of said Section 25; thence Southerly along the East line of said Section 36 a distance of 30.08 feet; thence deflecting to the right v-4 degrees 07 minutes a distance of 263,70 feet to the actual point of beginning of the center line to be hereinafter described; then coatiauing Westerly along the extension of said last described course a distance of 94.16 feet; thane on a tangential curare to the right, the radius of which is 1145.92 feet, the delta angle of which is 20 degrees 42 minutes 30 seconds, a distance of 414.17 fest; thence Northwesterly and tangent to said last described curve a distance of 1194.37 feet; thruce on a tangential curve to the le't, the radius of which is 572.96 toot, thc: delta angle of which is 46 degrees 2n minutes, a distance of 463.34 feet to the center 1_.ny of County road No. 70, as said strip of land crosses and lies within the following described parcel: Government Lot 4, Section 23, Township 118, Range 22, except the Wiest 315 feet of said Government Lot 4 lying North of the right -of say of the Minnesota Western Railroad and subject to an easement of said company to protect its right -of way by the erection and maintenance of portable snow fences, as described in Doc. No. 104847, Files of Registrar of Titles, and also except that part platted as "East Medicine Lake Addition," and also except that part lying between the Easterly line of Lot 1, East Medicine Lake Addition and a line drawn parallel with said Easterly line and distant 16 feet Easterly therefrom, measured at right angles thereto, and lying North of the Easterly extension of Central Aveuue as shown on the plat of said East Medicine Lake Addition; and also except -2- NEW NOV - e • ethat part embraced in the plat o" East Mee'.lclns Lake 2nd Addition, and also except that part embraced in Registered Land Survey No. 921, and also except that part lying Northeasterly of a line drawn at right angles to the center line of South Shore Drive as platted in East Medicine Lake lead Addition to the Southwest corner of Registered Lane Survey No. 942, and the extension of said line, together with a temporary easement for construction purposes 0017 over a strip of Icnd having a width of 70 feet on either side of the above-deseriovc:. center line, -also- a triangular parcel „f land for street purposes described as follows: Starting at the Northeast corner of Lot D, Registered Lane Survey 333, thence North- easterly along the Southeasterly right -of - my 1IU* of County Road No. 70, said right-of- way line having a bearing of North 870 021 East, a distance of two hundred four and sixty-si:-ons-hundredth (204.881) feet more or less to the point of beginning; 11,lence Easterly on a line bearing North 89 27' East a distance of one hundred eighty and no owe hundredth (I 50.00') feet to a point; thence Northerly on a line bearing North 10 51' West to a point on the South right- of-way line o: County Road No. 70 a distance of ninety and forty six one hundredth (90.481) feet more or less; thence Southwesterly along the South right-of-way line of County Road No. 70 to the point of beginning. 2. The Clerk -Administrator is directed to prepare a certified copy of this resolution for use in said proceedings." The above notion was seconded by Councilman Hunt and upon vote being taken thereon the following voted in &vor is thereof: Mayor Staples, Councilmen Q'P'allon, and Hunt.
