HomeMy WebLinkAboutCity Council Resolution 1966-228EXTRACT OF MINUTES OF REGULAR MEETING OF VILLAGE COUNCIL OF VILLAGE OF PLYA1OUTH, MINNESOTA December 12, 1966 Pursuant to due call and notice thereof a regular meeting of the Village ^ouncil of the Village of Plymouth was held on December 12, 1.966 at the Village Hall, 13800 State Highway No. 55, commencing at 7:30 o'clock P. M. The following members were present: Mayor Staples, Trustees O'Fallon, Hunt, Hagen and Renner. The following members were absent: None. introduced the following resolution and moved its adoption: "Resolution No. 66- 22% A RESOLUTION AUTHORIZING THE INCLUSION OF THE VILLAGE OF MEDICINE LAKE IN THE PLYMOUTH SANITARY SEWER PROGRAM WHEREAS the Village of Medicine Lake has approached the Village of Plymouth for the purpose of working out an 4arrangement whereby the Village of Medicine Lake can make use of the sanitary sewer system of the Village of Plymouth and, WHEREAS the Village of Medicine Lake has scheduled public hearings for the construction of a system of lateral sanitary sewer pipes within said Village to connect to the interceptor .sanitary sewer pipes of the Village of Plymouth and, WHEREAS the Villagc of Plymouth has designed its system to make it possible for the Village of Medicine Lake to connect 0 i • to said system and, WHEREAS the Village of Medicine Lake has an agreement with the Village of Golden Valley whereby the Village of Golden Valley has assigned a conditional sewer capacity in its system for the sewage of the Village of Medicine Lake and, WHEREAS designated officials of the Village of Medicine Lake and the Village of Plymouth have met and negotiated with respect to the charges to be made to the Village of Medicine Lake by the Village of Plymouth for handling the sewage of the Lake Village of Medicine✓ which negotiations have resulted in a tentative agreement of the parties subject to approval of the respective Village Councils of each of the Villages, NOW THEREFORE BT IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS: 1. The Village of Medicine Lake shall be permitted to hook its lateral sanitary sewer system into the system of the Village of Plymouth. 2. The Village of Medicine Lake shall pay to the Village of Plymouth a sum of money equivalent to the assessments levied against Plymouth property owners on an acreage basis and on a unit basis for residential, industrial and commercial land which sum shall be payable at the time the hook-up is made. The unit charge shall be made against those portions of the Village of Medicine Lake now developed and when later development occurs on any presently undeveloped parcel, the unit charge will be levied and collected from the 'Village of Medicine Lake at the time of such development. 3. The Village of Medicine Lake shall adopt an ordinance imposing the sanitary sewer rate charges upon sewer users within the Village of Medicine Lake as are in effect for users in the Village of Plymouth. 4. The Village of Plymouth will approve the construction of the sewer system of the Village of Medicine Lake and upon its completion will assume all obligations for maintenance thereof. 5. The Village of Plymouth will assume all obligations for billing users of the Medicine Lake system and all -2- } payments r-iude by such Uscers' shall be paid to the village of Plymou . 60 'the Village of Plymouth will assume the obligation of the Village of Nbidicine 'Lake to the Village of Golden Valley for, all sewer- charges Including the annuo-1. sewer '*'adtal.charge represented ' to be in the sum of $375.00.per year. ?, Upon notification of the acceptance by the Village Council o-fthe Village of Medicine Lake of the above conditions the Village Attorney is authorized to work with the Village Attorney of the Village of Medicine Lake in the preparation of a contract betweenthe parties reflecting tide above terms and conditions. S. The Mayor and Clerk,-Adminstrator are authorized and directed to execute such contract on behalf of the Village of Plymouth. 9. The Village of Medicine Lake will maintain its separate contract with the Village of Golden Valley as to sewer capacity and charges. - The above mot ion was seconded by ' i; t ) N and upon vote being taken thereon the following voted in favor thereon: Mayor Staples, Trustees O'Fallon, Hunt, Hagen and Renner.
