M. at the Village Hall, 13800 State Highway #55. The following members were present: VWor W&pUw, lrwste Q•Fallft, x"t, a#" am a=016 the following members were absent: A� Rearurve-R Mayor Staples introduced the following resolution and moved its adoption: RESOLUTION NO. ti• 191 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR X.I.P. N►WMT gra FROim 016") WHEREAS. pursuant to due and propeer notice according to law an assessment hearing was held on the !tr W of October, 19" relating to X.I.F. sudtary News Frojeat (D -U) and, WHBREAS, all persons present desiring to be heard were heard and their objections, if any, were noted, NOW, THEREFORE, BE IT HEREBY R88OL.VED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH, MINNESOTA AS FOLLOWS: 0 1. The Village Clerk has, with the assistance of the engineers heretofore selected by 'Mf"nc3i'-Tor such puT pose, calculated the proper amounts to be specially assessed for X.I.P. R"I" Omer nV iset (R -M against every assessable lot, piece or parcel of )and, In accordance with the provisions of law, and has pre- pared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against same. 2. Notice has been duly published as required by law that this council would meet in regular session at this time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and objections have been filed. 4. This Council finds that each of the lots, pieces or par- cels of land enumerated in said proposed assessment was and is specially benefited by the construction of H.I.P. ft"U" Nws Prej"t 01-06) In the amount in said proposed assessment not opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5. Such proposed assessment is affirmed, adopted and con- firmed, and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 8. Said assessment so affirmed, adapted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for U414P. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the came have been paid at the rate of percent per eanum. 8. Such assessment shall be payable in $p equal annual installments payable on the lot day of January in each year, beginning in the year 19, and continuing until all of said installments shall -nave been paid each installment to be collected with taxes collectible during said year by the County Auditor. To the first installment shall be added interest on the entAre assess- ment from the date hereof to December 31, 19 �. To each subsequent installment shall be added intere� for one ! year on all unpaid installments. -2- • 9. The Village Clerk is hereby directed to make up and file 1n the office of the County Auditor of 0-�1a1 County a. certified statement of the amount of all of such unpaid assesemerts and tha amount which will be due thereon on the 1st day of January in each year." The above motion was eeconded by Trustee Hunt and upon vote being taken thereon, the following voted in favor thereof: Nayor Staples, Trustees O'Fallon, F.agen and Hunt. the following voted against: No .e. Whereupon said resolution was declared duly passed and adopted.
