Village of Plymouth
RESOLUTION
Pursuant to do call and notice thereof, a regular meeting
of the Village Council of the Viling+e of Plymouth, Minnesota,
was held u;, the 4th day of April ; 1966.
Time 'ollowing members -ere present: Mayor Staples, Trustees
O'Fallon, Renner, Bunt and Hagen; and the following members were
abimnt : None

r 11 1 T , ` introduced the following resolution and
moved its ad6pt ions :
HHEEMS , it is necessary in connection with the Beacon
Heights Storm Sewer Project that permission be obtained from
the Chicago and North Western Railway for use of their right
of way in connection with said project, and
WHEREAS, negotiations have been undertaken with said railway
company for permission to use such right of way for such purpose,
and
MEMAS, said railway company Was -resented to the village
a proposed license agreement which would permit the village to
use the right of way for instalation of such storm sewer, and
WH88RAS, said agreement provides for the payment by the
village to the railway company of the sum of $840.00 as s one
time charge for the use of such right of way,
NOW THEREFORE, BE IT HEREBY RSSOLVSD BY T88 VILLAGE COUNCIL
OF THE VILLAGE OF PLYNOM AS FOLLOWS:
1. That the license agreement submitted by the Chicago
and North Western Railway Company relating to the
use of a portion of their right of way for the
installation of storm sewer in connection with the
Beacon Maights Storm Sewer project be and it hereby
is approved.

2. That the Mayor and Clerk -Administrator are authorized
and direotead to oxecu:e said license agreement on
behalf of the Village of Plymouth.
They motion for the adoption of the foregoing resolution
was duly seconded b and upon vote beim

taken thereon, the following voted in favor thereof: Mayor
Staples, Trustees € *ftlloa, Renner, Hunt and Hagen; the
following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.

I, the undersigned, being the duly qualified and acting clerk
of the Village of Plymouth, Minnesota, hereby certify.that I have
casre ally compared the attached and foregoing extract of minutes
of h regular meeting of the Village Council of said village held
April 4, 19", with the original thee"Of on file in my office
and the mase to a full, true and complete transcript therefrom
insofar as the same relates to the license agreement with the
Chioago and North Western Railway Company relative to the Beacon
Heights Storrs Sever project.
