HomeMy WebLinkAboutCity Council Resolution 2013-292CITY OF PLYMOUTH RESOLUTION No. 2013-292 A RESOLUTION TO APPROVE ENCROACHMENT AGREEMENT FOR A GARAGE WITHIN A DRAINAGE AND UTILITY EASEMENT AT 2730 BLACK OAKS LANE WHEREAS, staff requested the City Council approve an encroachment agreement allowing a garage to be constricted within a drainage and utility easement at 2730 Black Oaks Lane; and WHEREAS, the encroachment agreement permits the garage and requires the property owner work with staff to avoid drainage impacts to the adjacent property owner; and WHEREAS, the owners property is legally described as: Lot 2, Block 3, Maple Dell, and that part of Lot 6, Block 5, Maple Creel., lying northerly and northwesterly of a line described as beginning at the southeasterly corner of said lot 2, thence on an assumed bearing of South 89 degrees 59 minutes 57 seconds East, along the easterly extension of the southerly line of said Lot 2, a distance of 31.60 feet; thence North 53 degrees 07 minutes 20 seconds East 4792 feet to a point on the northeasterly_ line of said Lot 6 distant 110.84 feet southeasterlv of the most northerly corner of said Lot 6, and there terminating. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth, the encroachment agreement that will allow the proposed garage in a drainage and utility easement. ADOPTED by the City Council on August 27, 2013. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
