RESOLUTION No. 2013-285
A RESOLUTION APPROVING THE VACATION OF DRAINAGE AND UTILITY EASEMENTS
IN THE NORTHEAST QUARTER SECTION 5, TOWNSHIP 118, RANGE 22
(STEEPLE HILL 2ND ADDITION)
WHEREAS, a public hearing with respect to said vacation was scheduled for August 27,
2013, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of August 27, 2013; and
WHEREAS, the City Council did hold a public hearing on August 27, 2013, to inform
any and all interested parties relevant to the vacation of drainage and utility easements in the
northeast quarter Section 5, Township 118, Range 22 (Steeple Hill 2" a Addition); and
WHEREAS, it was determined by the City Council that said easements are not needed
for public purposes; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA that the drainage and utility easements described as
follows be vacated.
Parcel Description
That part of West 60 acres of Northeast Quarter of Section 5, Township 118, Range 22,
Hennepin County, Minnesota, lying North of the northerly right-of-way line of Hennepin
County Highway No. 47 except that part described as follows: Commencing at the
northeast corner of said West 60 acres of the Northeast Quarter; thence South 00 degrees
08 minutes 02 seconds East, assumed bearing, along east line of said West 60 acres of the
Northeast Quarter, a distance of 496.14 feet to point of beginning of the land to be therein
described; thence South 89 degrees 51 minutes 58 seconds West a distance of 320.00
feet; thence South 00 degrees 08 minutes 02 seconds East a distance of 323.54 feet to
said northerly right-of-way; thence northeasterly along said right-of-way to said east line;
thence North 00 degrees 08 minutes 02 seconds West, a distance of 179.76 feet to point
of beginning.
Easement Descriptions
A perpetual easement for drainage and utility purpose over, under and across that part of
the above described property which lies northwesterly of the above described public
right-of-way easement and southeasterly of a line 60.00 feet northwesterly of, measured
at a right angle and parallel with the above described centerline (centerline is the
centerline of Hennepin County Highway No. 47, Plat 13).
Also together with a perpetual easement for drainage and utility purpose over, under and
across the west 6.00 feet, the north 6.00 feet and the most easterly 6.00 feet of said above
described property.
Also together with a perpetual easement for drainage and utility purpose over, under and
across that part of the above described property which lies 6.00 feet to the right of the
following described line: Commencing at the Northeast corner of said West 60 acres of
the Northeast Quarter; thence South 00 degrees 08 minutes 02 seconds East, assumed
bearing, along the east line of said West 60 acres of the Northeast Quarter, a distance of
496.14 feet to the point of beginning of the line to be described; thence South 89 degrees
51 minutes 58 seconds West a distance of 320.00 feet; thence South 00 degrees 08
minutes 02 seconds East a distance of 323.54 feet to the northerly right-of-way line of
Hennepin County State Aid Highway No. 47 and said line there terminating.
FURTHER, that the recording of the vacation resolution shall be accomplished with, but
prior to the recording of Steeple Hill 2" a Addition plat.
FURTHER, that said vacation shall not effect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary
sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to
continue maintain the same or to enter upon such way or portion thereof vacation to maintain,
repair, replace, remove, or otherwise attend thereof.
