The annual Legislative Dinner will be held at the Decathlon Athletic Club. Reception at 6:30, dinner at 7:30 p.m. Councilmembers desiring to attend should notify Laurie. 7. ASSOCIATION OF METROPOLITAN MUNICIPALITIES -- Thursday, January 31, 4:30 - 6:00 p.m.. The AMM is hosting a reception for legislators and City officials at the Kelly Inn - St. Paul. A copy of the invitation is attached. Please contact Laurie if your plan to attend. (M-7) 8. PLYMOUTH FIRE & ICE FESTIVAL -- Saturday, February 2, Parkers Lake Park. A listing of scheduled and ongoing events for the festival is attached. (M-8) 9. TOUR OF TARGET GREATLAND -- Representatives from George Hite's office have inquired about whether the City Council would be interested in touring the Target Greatland store in Apple Valley. The date of February 25 has been suggested. The tour would require approximately 1-1/2 hours. In order that we can return prior to the Plymouth Forum scheduled for that evening, it would be necessary to leave from the City Center at 2:30 p.m. The Council should indicate at the January 28 meeting whether they are interested in conducting such a tour and if so, whether this date and time is satisfactory. FOR YOUR INFORMATION..... 1. STATUS REPORT ON PUPS -- On Tuesday, January 15, 22 bids were received by the City of Maple Grove for the construction of the PUPS Animal Impoundment Facility. The bids ranged from $485,000 to $621,307. The estimated construction cost supplied by the architect was $519,000. The low bidder, W. H. Cates Construction at $485,000, was recommended and approved by the Maple Grove City Council on January 22. During this next week, permits for the building will be taken. It is anticipated that construction will begin on March 1. There is a 180 day construction time limit. This means that the facility should be done by August 1. It will be necessary for Plymouth to negotiate with Corcoran Pet Clinic for a two month extension to the existing contract. Future PUPS board meetings are scheduled for the last Thursday of each month. The next meeting is scheduled for 2 p.m., February 28, 1991 at the Maple Grove City Hall. Review and discussion of proposed job description for Animal Containment Coordinator. 2. 1991 WATER RESTRICTIONS -- One of the communications tools we use to reach the public is an attachment to the sewer and water bill. There is a substantial lead time in the preparation of these pieces. The attachment which is planned to go out with the April bills will discuss May 1 through September 30 water restrictions. Attached is a copy of a flyer used last year to summarize the water restriction program. Unless advised otherwise by the Council at the January 28 meeting, we will assume that the 1991 Water Restriction Program will be identical to 1990 and will prepare this information piece accordingly. If the Council desires that revisions be considered for 1991, we will put this item on the February 4 agenda for discussion. (I-2) 3. LEAGUE OF PLYMOUTH VOTERS -- Mark McCullough, attorney representing the League of Plymouth Voters, in a letter dated January 21 to Laurie Rauenhorst, has requested the City to furnish all data "related to any complaint or other matter relating to the League, or its members." Mr. McCullough's letter is attached together with a January 23 letter from Laurie responding to the request. Also attached is a League of Plymouth Voters flyer on their petition drive. (I-3) 4. ,SCHMIDT LAKE ROAD MORTHWEST BOULEVARD EAW -- The draft Environmental Assessment Worksheet for the Schmidt Lake Road/Northwest Boulevard project has been completed and submitted to the Environmental Quality Board (EQB) for review. Attached is a memorandum from Dan Faulkner on the process the EQB will be following during the 30 day review period. A copy of the draft EAW is available for Council review in either the Engineering Department or City Manager's office. (I-4) 5. WETLANDS TASK FORCE -- The task force appointed by the City Council last year to investigate wetland regulations has conducted its last meeting. Community Development Director Blair Tremere is preparing the final report from the Task Force based upon a draft report that was approved at the last meeting. The report will be sent to the City Council in the next few days and the consideration of the report will be an item on the February 4 Council agenda. James Gudal is requesting approval of a zoning change from the FRD (Future Restricted Development) District to R-2 (Low -Density Multiple Residence) District, Preliminary Plat and Variance for the "Gudal Addition." (90087) This request will be heard by the Planning Commission at their January 30 meeting. 7. MINUTES• a. Wayzata Board of Education, Public Hearing on 1990 Property Tax Levy, December 10, 1990. (I -7a) b. Park and Recreation Advisory Commission, January 10, 1991. (I -7b) 8. "KIDS FOR SAVING EARTH NEWS" -- Attached is an excerpt from a "Kids for Saving Earth News" which talks about the Plymouth Parks and Recreation Commission and City Council working with local citizens on a neighborhood park project. This is the first issue of the paper, which is sponsored by Target stores. (I-8) 9. TOWN MEETING RESIDENT FEEDBACK FORMS -- Copies of resident feedback forms turned in at the January 22 Town Meeting are attached. The Council will be given copies of City staff responses as they are prepared. (I-9) 10. CUSTOMER SERVICE LINE -- Documentation on a call received on the Customer Service Line is attached. (I-10) 11. WASTE TRANSFER STATION -- The status report on Hennepin County's application for a Waste Transfer Station is attached. (I-11) 12. CORRESPONDENCE: a. The League and its members are investigating a criminal complaint made and referred to in your "Memo" of January 11, 1991, enclosed. Please see my letter to the Hennepin County Attorney's office, enclosed. The League demands that the City of Plymouth furnish and deliver all data required under Minn. Stat. § 13.01 et seq., related to any complaint or other matter relating to the League, or its members. The City's response should include all prior council minutes, memos, letters or other documents within the scope of this demand and all similar documents created in the future. The response should also include all "executive" or other similar meeting minutes, unless the City claims a privilege. If the City refuses to furnish any data, please indicate the nature of the data and the reasons asserted to support the City's position, as required by law. You inquired as to whether signers of such a petition must be registered voters. Minnesota Statutes, Section 205.10, Subd. 1 states that a special election may be held "on a question on which the voters are authorized by law or charter to pass judgment." A special election on such a question may be ordered "upon a petition signed by a number of voters equal to 20% of the votes cast at the last municipal general election." In my opinion, the signers do not need to be registered voters, but merely eligible voters. Minnesota Statutes, Section 201.014 states that an individual who is 18 years of age or older, a citizen of the United States, and a resident in Minnesota for 20 days at the time of the election is eligible to vote, provided that the person has not lost his or her civil rights and is not mentally incompetent. As far as your question regarding the form of the petition, I would merely recommend that the petition contain the names and addresses of the persons signing it and a statement that by signing it they are acknowledging that they are eligible voters in the City. On December 17, 1990, the City Council adopted Ordinance 90-41, which purports to cancel the City's November 5, 1991 municipal election and extend the terms of the council members one year beyond their elected term. 'If you review the entire December 17, 1990 video tape (through the adoption of the ordinance) you will understand the impetus behind the League's birth. The League is a non-profit corporation formed under Minn. Stat. § 317.A. Enclosed is a copy of our filed articles and the certificate of incorporation. The League supports no candidate, no political party, nor any proposition presently placed on a ballot. He said a Complaint had been rcceived regarding a meeting at City Hall on December 17 generally relating to monies collected by a group, whether that group qualifies as a political action committee (PAC),, and the Mayor. He asked the type of meeting and who had requested use of the City Center. I informed him that, if we were talking about the same incident, it took place during a regular City Council meeting during discussions on the change in City Council election years. A member of the public, -Al Clausnitzer, mentioned the group "Plymouth Citizens' League" and other comments were made later by several people about collecting money. I informed Mr. Huss that not all comments are included in the meeting minutes, but some references to the incident were. Mr. Huss stated he was aware that subsequently there was an attorney's opinion on --ollecting funds at the City Center, but he said that didn't rela-e to election law and whether violations exist relating to whether this group qualifies as a PAC. Mr. Huss asked me if 7 had a contact or information relating to the "Plymouth Citizens League". I stated that the group, if it is the same one, may now use the name "League of Plymouth Voters". That group has requested use of the City Center for future meetings and I provided Mr. Huss with the contact and address for that group: Dave Anderson (home phone 553-2800), League of Plymouth Voters, a nonprofit 'corporation, P.O. Municipalities can allow private groups to use public buildings for private purposes that do not interfere with the public use or disturb the peace 'as long as the City itself is not engaged in any private business. John Wright & Associates v. City of Red k'i a, 254 Minn. 1, 93 N.W.2d 660 (1959) . Based on general legal principles, therefore, there is no prohibition against private groups using the City Center even though donations are solicited from the participants at the meeting. Consistent with the general legal principles that apply in this area, the City Council has approved guidelines allowing the use -of the City Center. .by private individuals. These guidelines normally pertain to advance requests by groups to use the City Center. I am enclosing a -copy of those guidelines for your reference. Paragraph II of the guidelines states that the City Center is available for the use for public and privatemeetings by organizations whose membership substantially includes Plymouth residents. Paragraph II further states that the City Center is not to be used "for commercial enterprise, private ceremonies, religious ceremonies, and profit making activity or any activity 3 The Honorable Kim M. I do not know whether the contributions that were apparently solicited on December 17, 1990 were for a commercial enterprise or for a profit-making activity. Therefore, I cannot determine whether there was any violation of the City guidelines. Violations of the City guidelines, however, do not create any legal cause of action in favor of the City. • The City's remedy in such a situation would be to prohibit any group that violates the guidelines from using the City Center in the future. This letter answers your question only as it relates to general legal principles applicable to the use of City property. I have not attempted to ascertain whether the alleged solicitation activity complies with state laws regarding political campaigns or political contributions because other agencies are specifi- cally charged with enforcing those laws. Issues regarding political campaign laws are more appropriately addressed by the county attorney, and issues relating to political contributions or expenditures are handled by the Minnesota Ethical Practices Board. Accordingly, I express no opinion on the issue as it may relate to those laws. In summary, there is no general legal prohibition against private groups using City -owned property as long'as the City itself does not engage in any private business. Any use of City -owned property should, however, comply with the City's guidelines. The EAW has been prepared in accordance with State Environmental Quality Board rules and covers the construction of Schmidt Lake Road from Pineview Lane to I-494 and Northwest Boulevard from 45th Avenue North to 54th Avenue North. Both roadways are designated as "Minor Arterials" in the City Thoroughfare Guide Plan and are anticipated to be 52 feet wide, four lane bituminous roadways with curb and gutter and utility improvements. The draft EAW was submitted to the Environmental Quality Board on January 14, 1991 and subsequently published in the monitor for a 30 day review period which ends on February 20, 1991. In addition, a news release was submitted to the Weekly News and the Plymouth Sailor for publication in the January 17, and January 23 issues respectively. In addition, a copy of the draft document is available at the Ridgedale Regional Library for interested parties to review. The hearing was broadcast live on cable television Plymouth Channel 59/67 and Wayzata Channel 8, and delayed broadcast on Minnetonka Channel 35. Board Chairman John Dettloff called the hearing to order and Board Clerk Kenneth Hopkins called the roll. The following School Board members were present: Mrs. Sylvia I. Carlson, Mr. Howard B. Casmey, Mr. John C. Dettloff, Mr. Kenneth R. Hopkins, Mr. Paul L. Landry, Mrs. Mary H. Smith, Mrs. Marilu Theodore, and Dr. David R. Landswerk, Ex Officio. School Board members absent: no one. At the August 20, 1990, Special Board Meeting, the School Board adopted a resolution providing for this public hearing and the required legal notices were published and posted. Regular Meeting Roll Call Purpose of Hearing �a1 Wayzata Board of Education Public Hearing - December 10, 1990 Stan Tikkanen, Executive Director of Finance and Business Services, detailed the recommended $33,638,367.20 which included the maximum levy limita- tion in each category with the exception of Community Service where a reduction in the adult basic education from $136,612.18 to $86,683.00 was proposed. He further indicated that with the increase in tax base and changes in tax laws, District 284 homes with market values over $101,500 would experience a decrease in their school district taxes and homes valued under $101,500 would see a small increase. Chairman Dettloff asked if anyone in the audience wished to address the School Board on the recommended 1990 Payable 1991 Property Tax Levy. No individuals came forward. A motion was made by Mr. Casmey and seconded by Mrs. Carlson to approve the final Levy Limitation and Certification 1990 Payable 1991 in the amount of $33,638,367.20 for Independent School District 284. CALL TO ORDER Chair Freels called the January meeting to order at 7:04 p.m. in the Council Chambers. 2. APPROVAL OF MINUTES A motion was made by Commissioner Anderson and seconded by Commissioner Rosen to approve the minutes of the November 1990 meeting as presented. The` motion carried with all ayes. 3. VISITOR PRESENTATIONS a. Athletic Associations. None were present at this meeting. b. Staff. Employee of the month awards were given out by Mary Bisek to Gerry Rapson, a clerical assistant in the Park and Recreation office; Ann Rein, a lifeguard and children's program leader; and one by Rick Busch to Michelle Severson, a scorekeeper for our athletic programs. Mary stated that an all time high attendance was recorded for a warming house, at Parkers Lake on Sunday, January 6, when approximately 800 people used the facilities there. A Plymouth Speed Skating Club race was being held that afternoon at Parkers, which contributed to that figure. Mary discussed the Fire and Ice Festival coming up on February 2, and asked if the commissioners would again tend to the bonfire. A sign up sheet was made available to the commissioners with three, two-hour shifts indicated. Mary stated that some new attractions at this year's Festival include a kite show, clowns, and a dog sled demonstration. A couple of new programs that Park and Recreation is involved in are a Youth Leadership Workshop cosponsored with Wayzata and Robbinsdale Community Education, Camp Fire and the Red Cross, and a Folk Arts grant. Mary explained to commissioners that the recreation section of Plymouth News will be changing formats again. It will go from a two column publication to three columns, with no front or back cover, separating it from the rest of the newsletter. It will still have a table of contents, however. Program descriptions will be condensed as much as possible to take up less space, and recreation information will be in six issues instead of four. January 1991 PRAC Minutes Page 2 4. REPORT ON PAST COUNCIL ACTION a. Council approved charging a $5 non-resident fee to youth participating in athletic associations who live in cities that do not provide athletic facilities. This was done during their budget study sessions as a way to hold down maintenance costs. Commissioners were surprised at this action by the Council, since PRAC had recently discussed the issue but had not made any recommendation to Council at this time. b. As part of approving the 1991 budget, Council chose to close the West Beach for the summer of 1991. 5. UNFINISHED BUSINESS a. Special facilities - continue discussion. This item was tabled until the next meeting. 6. NEW BUSINESS a. Review plan for lighting Parkers Lake skating rinks. Director Blank stated that the Plymouth Speed Skating Club had appeared before the City Council requesting the installation of lighting on the rink for reasons of safety. Council referred it to PRAC to hold a public meeting, so that citizens living on the lake could be invited to comment. Steve Miller, a member of the Plymouth Speed Skating Club, spoke of the benefits that speed skating has offered his family. He stated that lighting the rink would provide for greater safety when night skating, which is when practices are held, and when most families can attend. He indicated that Tuesday and Thursday nights are for practice, and that the Club might start a speed skating clinic on Monday nights. Greg Oly, president of the Plymouth Speed Skating Club and a Plymouth police officer involved in the DARE program, stated that the club is the largest in the state, and he is confident it will become the largest in the nation. He indicated that the Parkers Lake speed skating rink is very well maintained, so that the ice conditions are excellent, however, cracks do develop in the ice with temperature changes, and these cracks are difficult to see at night. Speed skaters can attain speeds of 30 mph, and injuries can occur if skaters hit these cracks. Lights would help skaters see these cracks in time to skate around them. Members of the club range in age from 4 to 50, and membership continues to rise. Marsha Videen, 1151 Kingsview Lane, lives on the east side of Parkers Lake and is concerned about the lights shining into her living room. She stated she doesn't wish to look out her window at light bulbs. She asked about the cost to install the lighting and wondered if it would come from funds that are meant to fund some other project. Director Blank stated the estimate is $15,000 for two light poles, and that the money is coming from the park dedication fund and would not mean giving up some other project. He often uses the speed skating rink and is pleased at the possibility of having the rinks lighted. He feels that Parkers Lake is an ideal place to skate, with the pavilion serving as the warming house and feels that lights would be a welcome addition. He urged the park commission to recommend approval of the lighting and is confident that it will be done in such a way so it won't affect the residents living on the east side of the lake. Chair Freels closed the public meeting at 7:45 and then asked commissioners if they had any questions. Commissioner Hanson asked Greg Oly if two light poles would be enough to provide sufficient lighting. He responded that they would be placed in such a way that they cross over each other, so that both the pleasure skating rink and the speed skating rink would benefit from both poles. Commissioner Rosen questioned whether the speed skating rink could be placed somewhere else, perhaps in one of the playfields. Director Blank responded that no other warming house is large enough to accommodate the numbers of people that turn out for speed skating, and that the size of the rink is such that it would be difficult, but not impossible, to place it in one of the other parks. It does destroy the grass underneath, however, and if PRAC chose to move it to another park, it would not make sense to try and reseed that area every spring, which would be rather costly. When informed that people all over the nation would soon know about the Plymouth Speed Skating Club, Commissioner Rosen remarked that the good publicity for the City will be worth the $15,000 cost of installing the lights. Commissioner Rosen also commented that the minutes should reflect PRAC's belief that the approval of lighting would be to benefit all the skaters of Plymouth, not just the speed skating club. Commissioner Hansen stated that adequate funding should be allocated to ensure a good lighting job. A MOTION WAS MADE BY COMMISSIONER ROSEN AND SECONDED BY COMMISSIONER HANSON TO.RECOMMEND THE INSTALLATION OF PERMANENT LIGHTING AT PARKERS LAKE FOR THE PLEASURE SKATING RINK AND THE SPEED SKATING RINK. THE MOTION CARRIED WITH ALL AYES. Director Blank stated this item will be on the City Council's January 28 agenda. If passed by the Council, the lighting probably would be installed sometime in 1991, but would not be ready until next winter's skating season. Greg Oly asked if it was possible to install some sort of temporary lights for the remainder of this skating season. Director Blank said he would look into it. b. Review Pike Lake Regional Park Plan. Director Blank had sent out with their packets copies of the Pike Lake park plan to commissioners to review and make comments on. He stated the plan had not changed any since originally done in 1976. Rick Busch reviewed the changes proposed for 1991 and pointed out that items being deleted were lined out and new items were underlined. He stated that in previous years, there have been two rental policies, one for the Zachary softball complex and one that covered all other parks. For purposes of simplicity and to relieve any confusion, the policies have been combined into one. Rates proposed for 1991 all increased with the exception of lights and the fee for the park attendant. When asked why those rates were not increasing, Rick responded that they were at an appropriate level now. Other changes include the new policy that facilities will not be available to non-resident groups, because of their high demand by resident groups, and the new $5 non-resident fee being charged to youth in athletic associations that live in cities not providing facilities. Commissioner Beach stated she heard that the Wayzata Traveling Soccer Club will be approaching PRAC requesting that the $5 non-resident fee be waived. COMMISSION PRESENTATION Chairman Freels commented on the need for a sidewalk along Plymouth Boulevard from Highway 55 to County Road 9. On more than one occasion he has almost collided with pedestrians and bikers using the roadway, and he feels the situation is very dangerous. He has written to the City Council about his concerns and has had no response from them. Director Blank commented that the downtown Plymouth sidewalk plan does call for sidewalk along Plymouth Boulevard and that normally it would be installed as the downtown area develops. Chairman Freels believes the sidewalks should be installed now, before a tragedy occurs. The charge would be $2.50 per month but would apply only to new customers who do not subscribe to premium services. This address is approximately two blocks east of Troy Lane. The property owner was stating her concern regarding the numerous accidents which have happened at this curve. This curve is clearly marked with a 35 m.p.h. warning sign from each direction. Also, there is a directional arrow as you approach the curve from either direction. I am attaching copies of four reports of accidents which have happened at this location during the last three years. I believe two of the four accidents are attributable to excessive speed on the curve. The property owner who talked with Councilmember Helliwell also stated that there are numerous unreported accidents at this location. The vehicles are undamaged and they are able to drive back onto the roadway. I am requesting that the County investigate this curve for additional safety considerations. At the joint meeting between the Plymouth City Council and Library Board, Bob Rohlf indicated that there are a number of Hennepin County municipalities which had donated property to the Library Board for a community library site. Would you please supply me with a list of those communities, including the year in which the property was donated, the size of the property donated in acres, the location of the property, the size of the library structure initially and ultimately developed on the site, and the value of the property at the time of donation.
