Don't Spike the Egg Nog:
Plymouth Police Department to Target Impaired Drivers over the Holidays
Holiday Safe & Sober Impaired Driving Enforcement period begins Dec. 16
Plymouth, Minnesota - Plymouth Police Department officers will patrol over the river
and through the woods during a stepped-up impaired driving enforcement effort, Dec. 16 - 31.
The Minnesota Department of Public Safety Office of Traffic Safety will coordinate the
Safe & Sober effort that will include participation from 300 city and county law enforcement
agencies and the State Patrol.
"The bottom line is red -nosed drivers will be blitzed by our officers," said Sergeant Jon
Christianson. "We will be gift wrapping safe roads in DWIs this holiday season."
Historically, the holiday season is one of the deadliest periods on Minnesota roads. Last
year in Minnesota, there were 12 traffic deaths and over 600 injured during the Christmas and
New Year's holiday weekends.
In 2004, there were 18 alcohol-related deaths and 455 injuries in Hennepin County. The
economic impact of these deaths and injuries cost the county approximately $24.9 million. Last
year, more than 7,355 impaired motorists were arrested for DWI in Hennepin County. In
Minnesota, more than 400,000 licensed drivers have a DWI.
Statewide in 2004 there were 177 alcohol-related traffic deaths — the lowest number of
impaired driving deaths ever recorded in Minnesota. Public Safety officials attribute the drastic
decline in deaths to stepped-up enforcement efforts, new legislation and public education.
In August, the state's legal alcohol -concentration level lowered to 0.08. The Plymouth
Police Department urges everyone to be aware of the amount of alcohol that one can consume

before becoming impaired. The impact of alcohol is determined by a number of factors: gender,
weight, food consumed prior to drinking and pace of drinking. Motorists can be arrested for
DWI even below 0.08 "If law enforcement officers can determine alcohol or drugs caused you to
make driving errors — no matter what the alcohol -concentration level — you can be arrested,"
said Christianson.
Safe & Sober is funded by the National Highway Traffic Safety Administration. The
program is designed to reduce traffic -related fatalities and serious injuries.

Robbinsdale Area Schools invites your input and comments on the proposed repair,
reconstruction and improvement of various site amenities of Armstrong High School.
Those projects are proposed to occur during the next five years.
Robbinsdale Area Schools will be making application to the City of Plymouth for a Site
Plan Amendment, Conditional Use Plan Amendment, and Interim Use Permit associated
with the proposed projects.
The major proposed multiyear phase projects include the following:
• Replacement of the stadium turf,
• Replacement of the stadium field scoreboard,
• Reconstruction of the physical education/junior varsity field turf,
• Adjustment of the physical education/junior varsity field to provide increased
clearances to potential player obstructions and hazards,
• Repairs and reconstruction of the softball and baseball field area,
• Reconstruction of the five existing tennis courts,
• Addition of two new tennis courts,
• Reconstruction of the west staff stall parking lot,
• An approximate 20 stall addition to the west parking lot, and
• Improvements to the storm water management system.

Plymouth commuters top toll -lane list

Who are the biggest users of the state's first toll lane? The commuters of Plymouth.
New figures from the Minnesota Department of Transportation show that Plymouth residents hold 14.4 percent of the roughly 9,000 windshield
transponders that allow solo drivers to pay an electronic toll for a quick trip in the Interstate Hwy. 394 express lanes.
The picture of users was drawn from ZIP codes on toll accounts. MnDOT has no other information about them.
Jodie Severson of Minnetonka is one faithful user. She takes the toll lane daily to and from work at a downtown law office just to make her commute
faster. She estimates it saves her 15 minutes each way.
"I like the reliability, and I don't mind paying for it," she said.
Plymouth may top the list of users because it has more two -earner households and therefore more commuters than the other suburbs that flank I-394, said
Rep. Jeff Johnson, R -Plymouth, a key player in the opening and operation of the lanes.
Minneapolis shows up second, possibly because toll lane users opened accounts under downtown work addresses instead of home addresses, MnDOT
officials speculate. Otherwise, Minneapolis' lofty ranking is surprising because the toll lanes cater to the commute east into the city in the morning and west
out of the city in the evening.
The distribution of toll -lane users emerged from a study of the lane in its first year of operation
Just before Thanksgiving, MnDOT opened a new lane on westbound I-394 between Louisiana Avenue and General Mills Boulevard, the main exit for
Hwy. 169.
By adding new space for traffic entering and exiting the freeway, MnDOT says the extra lane has relieved congestion west of Louisiana in the two general
lanes.
Some commuters say it wasn't enough.
"They've added that lane, but the real bottleneck is occurring before that," said Allan Haag, of Minnetonka, who works in downtown Minneapolis. "Too
bad they missed it by half a mile."
John Sarles, who works downtown and lives in Wayzata, said the lane created immediate improvement in the traffic flow west of Louisiana Avenue, "but it
doesn't seem like they went back far enough. The congestion starts around Park Place."
Nick Thompson, manager of the toll -lane project for MnDOT, said there was no space to extend the new lane farther east, where heavy traffic enters I-394
from Hwy. 100.
MnDOT announced plans to add the lane at a cost of $2.8 million after commuters complained that converting the carpool -bus lanes to toll lanes worsened
congestion in the freeway's general lanes. The opening of the new lane is the final concession to drivers who liked the freeway better before tolling began.
Kimberly Lange, who commutes on I-394 from Farmington to Minnetonka, said she thinks that's fair. "We still have the option to use the toll lane if we
choose to pay for it. So they've kind of met us in the middle. It's not as big a hassle as before. Now the ball is in our court. If we want to get where we are
going quicker, we have to use the toll lane."

A basin located between Lancaster Lane and Highway 169 south of Four Seasons Mall has
been identified by Bassett Creek Watershed Management Commission (BCWMC) as the
location of a potential water quality improvement for NorthWoods Lake. The basin is
identified in the BCWMC Northwoods Lake Watershed and Lake Management Plan as
NB -07 and in the City's inventory as 13144-NBO1. The improvement would include
redirecting stormwater from Lancaster Lane to a basin upstream from NB -07 and
excavating NB -07 to enhance its ability to remove sediment and nutrients.
BCWMC's CIP specifies that financing for the estimated $726,000 project will be
collected in 2008, 2009 and 2010. BCWMC projects are typically constructed by the city
in which they are located through a cooperative agreement. If the BCWMC's CIP
proceeds as currently approved, all the funding for this project will be in place for
construction in 2011.
In the interim, drainage maintenance activities will be performed in the basin to remove
blockages to flow. Such. maintenance is planned for this winter.

SUBJECT: Request to amend Massage Therapy Requirements
Attached is correspondence that staff received from Lisa Fecarotta who is requesting that
the Council consider amending the location requirements where massage therapy can be
practiced as contained in the City Code. Ms. Fecarotta would like the ability to provide
chair massage to companies on a weekly or monthly basis.
According to Section 1135.15, Subd. 6 of the City Code, "Massage may be practiced only
by a certified massage therapist only at massage therapy centers licensed pursuant to
Section 615 of the code, or at the place of residence of the massage therapist." Therefore,
the City Code is very specific as to where the practice of massage could occur and
offering "portable" chair massages doesn't meet the requirements of the City Code.
It should also be noted that there are exemptions from the licensing requirement.
According to Section 113 5.03, "The practice of massage therapy is hereby declared to be
distinct from the practice of medicine, surgery, osteopathy, chiropractic, physical therapy,
or podiatry. Persons duly licensed in this state to practice medicine, surgery, osteopathy,
chiropractic, physical therapy or podiatry, nurses or persons performing therapeutic
massages who work solely under the direction of such persons, athletic directors and
trainers, certified by an accrediting agency and who are employed by an accredited and
licensed educational institution shall be exempt from the provisions of this section." The
Council's rationale, at the time when the location requirements were adopted, was to
regulate the activity.
After reviewing the attached request, the Council should inform staff if they desire to
have an ordinance drafted for a future Council meeting that would allow for the practice
of massage at locations other than at a therapist's place of residence or at a massage
therapy center.

Thank you very much for taking time to consider my request and submit my
proposal to the city council. My background is in the field of massage therapy. I am a
professional member of the American Massage Therapy Association and the National
Certification Board for Therapeutic Massage and Bodywork. I graduated from the Fox
Valley School of Massage in June of 1999 where we were required to complete 620
hours of study. Along with my schooling I am also required to complete 48 hours of
continuing education every 4 years in order to continue my present standing in both of
these organizations. I also am required by these organizations to have a $2 million
limit of liability insurance. All of which are up to date.
Per my inquiry over the phone, I am looking to start up another business in
Plymouth where I would be taking a massage chair to companies and providing a chair
massage for employees. I moved here in July from Green Bay, Wisconsin where I had a
successful massage therapy business. I would like to start my new business properly and
requested a Minnesota registration. As you mentioned this type of business is in the
category of "Out Call". I am not sure of your definition but to my knowledge this type of
business would not be considered an "out call" as it would be set up on a weekly or
monthly basis with the individual company.
I guess what I am requesting is an exemption for this type of business both for
myself and other therapist who may be able to start this. There is a lot of research
currently being conducted on the ability of massage (to include chair massage) to both,
reduce stress and improve productivity.
I am sure the city council has the best interest of the city of Plymouth in its heart
and that is why I would like them to consider this. I believe it would help both the
companies and the employees most of whom may live right here in Plymouth.
I would be very happy to provide the research and documentation or even conduct
a demonstration to the city council. References are available upon request.

• Express ridership (to and from downtown) is up by 10% over the same period last year.
• Dial -A -Ride has a ridership increase of 3.5% compared to the same period last year.
Plymouth Metrolink has continued to show strong ridership growth this year despite the fare
increase imposed earlier this year in the region and the minor service reductions the City put into
place in September. The fare increases and the service reductions have allowed Plymouth
Metrolink to operate within the 2005 operating budget and maintain the current transit fund
balance.

meeting. The motion passed in a unanimous voice vote.
Council Update:
Kurt gave an update on issues under discussion by the City Council.
Special Items:
a) Sleep—out Event
Diane reported that to date, only two people have registered for the event. Members
discussed the difficulties in online. Nine members reported that they would be able to
attend. Diane encouraged them to telephone registrations into City Hall on the Park and
Recreation Department line at (763) 509-5200. She said the City would review registrations
after the holiday and make a decision on how to proceed with activity plans.
Diane conducted an informal poll of the Council members and estimated only about 30
people would be likely to attend. She said that if only 30 people would be at the event, they
would eliminate the all night activities in the soccer dome and find things to do inside the
Plymouth Creek Center lower level. She asked the Youth Advisory Council to develop ideas

for program activities. Members agreed to decide on the program at the December 5
meeting. Chaperones will be contacted with scheduling information and what their
responsibilities will be at the event. Diane expected a decision would likely come by the end
of November.
Council members inquired whether Mayor Johnson would speak at the event. Staff agreed to
ask the Mayor about making an appearance.
b) Service Awards program plans
Kurt agreed to prepare a packet of materials from previous years for the Council to review.
Council members agreed to review past application forms in an effort to revise the 2006
applications to reflect more realistic community participation.
c) Youth Leadership program plans
Council members agreed to develop a list of possible speakers with a unifying theme for the
event. Anne offered to speak with her father about getting a list of resources from him.
d) Intergenerational activities
Heather reported that a December 5 meeting is scheduled for 3:30 PM at the Plymouth Creek
Center to plan an intergenerational roundtable for late February. She invited all Youth
Advisory Council members to attend the meeting.

This letter is sent with regard to Planning Area 2 and the upcoming Comprehensive Plan
Update for the City of Plymouth. My wife and I own a parcel of land with frontage, (but not
access), on Highway 55, in Planning Area 2. The address is 18910 Hamel Road, Plymouth
55446. We strongly support the inclusion of our property, together with the surrounding land on
the highway corridor, in a revised comprehensive plan that would allow for utility access, hook-
ups, and development. We also believe that our particular parcel which sits right on the
highway, should be zoned for commercial use in the updated comprehensive plan to be set forth
in June of 2006. We would like to be included in any discussion regarding the future zoning of
our property and the surrounding area. We have also informed Ms. Hurlburt, the City Planner, of
our position.

Dear Mr. Dutton:
I am responding to your request for partial refund of your liquor license payment. You
made the request for reimbursement of the City Clerk and of me last week. After
consulting with the City Attorney, I notified you that no refund is authorized or allowed
by State law. You subsequently spoke with the State Liquor Control Agency and then left
me a message that they told you a refund was allowed. However, we spoke with Marlene
at State Liquor Control today and she concurred that the statute is quite clear that a refund
is not allowed in the case of license revocation under State Statute 340A.408, Subd. 5(3):
Subd. 5. Refunds. A pro rata share of an annual license fee for a retail license
to sell intoxicating or 3.2 percent malt liquor, either on -sale or off -sale, may be
refunded to the licensee or to the licensee's estate if.
(1) the business ceases to operate because of destruction or damage;
(2) the licensee dies;
(3) the business ceases to be lawful for a reason other than a license revocation; or
(4) the licensee ceases to carry on the licensed business under the license.
The City Attorney and I believe that the intent of the legislation (Subd. 5 (3)) is quite
