No. 1133 -C - Area 1-2-3-4 September 15, 1960 SPEC IAL P tOV IS MNS DIV.,_.IS N A A-1 SEBCJGECAZIONS„IMM AEPLX The State of Minnesota, Department of Highways "Specifications for Highway Construction", dated V4y 1s 1959, and submitted fur approval by the Divi- sion Engineer of the Bureau of Public Roads on * rch 26, 1959, and all provisions of the State of Minnesota, Department of Highways "Requirements for all Projects Financed with Feral Aid Funis" dated January 5, 1955, and approved by the Buresu of Public Roade on January 24, 1955, shall apply on this Contract, except as modified or altered in the following Special Provisions. A-2 LABO$PROVISIONS The following requirements shall apply to all Work performed on the Pro- Ject by the Contractor with his own orgarization and with the assistance of workmen under his immediate superintendance and to all work performed on the Project by piece work, station work or by subcontract. They shall also apply to all labor employed on the site of the work and engaged in altering, assembling or repairing equipment used on the work, from the date on which construction operations are started until the date on which they are completed. The words "site of the work” shall be con- strued to mean not only locations an the right of way, but a:W job head- quarters, yard or building in the vicinity of the work, where labor em- ployed by the Contractor is engaged, during construction operations, in the type of work referred to above. The Contractor or his Subcontractor shall pay each mechanic and each laborer employed directly upon the site of the work, unconditionally and not less often than once a week, without any subsequent deduction or rebate, the net amount of wages after all lawful deductions accrued at time of pay- ment, computed at a wage irate which is not lose than the rate stated in the Special Provisions for such class. Labor position shall, so far as possible, be classified as indicated in the -CLASS" column in the listing contained in these Labor Provisions in which S means SKILLED LABOR, I means INTEMMIM GRADE LABOR and U means UNSKILLED LABOR. Unskilled Labor Unskilled labor shall include: (A) Drivers of Service Trucks and passenger cars; (B) Helpers to tourneymen, oraftemen and all other labor which re- quires no special skill or experience or the exercise of discretion and independent judgement. In the event the Contractor employs apprentice workmen under the occupa- tional training program of the State of Minnesota, Department of Education, or under the Division of Voluntary Apprenticeship of the State of Minnesota, Department of Labor and Industry, or under the Veterans Training Program of the U. S. Veterans Administration, he may pay wages to such apprentice workmen at rates approved by the appropriate governmental agency regardless of the ninimam rates hereinafter specified to be paid. Such employees shall be included in the Unskilled Labor Classification in the quarterly employment sueeariss, With an explanatory note thereon indicating the nuaber of such apprentices and showing their total hours and wages for the Period. In the event that the prevailing local wage rate for the same labor classi- fication engaged on public construction of similar type and character is one prescribed under local collective bargaining agreements between organ- ized labor and employers and is a rate higher then the minimum rate listed below, such local wage rate shall apply. Neither the establishment of each a local Wage rate nor any change in an existing collective bargaining agreement, after the date on which the Proposal is submitted, will be con- sidered as a basis for any claim by the Contractor for increased compen- sation. :he scale of wages to be paid shall be posted by the Contractor in a prominent and easily accessible place at the site of the work. A-2 Area 1-2-3-4 September 15, 1960 A-< (Continued) The Contractor shall have on file at his local job headquarters, and available fir inspection by any of his employees and by the Engineer, copies of the truck rentgl provisions as set forth in the Speulal Pro- visions for the prnjeots. A standard form of notice, approved by the State, advising the workmen that the various provisions above referred to are available for inspection, shall be posed by the Contractor in a conspicuous place at his local job headquarters where it may be conveniently seen by the workmen during the prosecution of the work. Copies of the various provisions and the stand- ard form of notice herein referred to can be secured from the State with- out charge. No fee of any kind shall be asked or accepted by the Contractor or any of his agents from any person who obtains work on the Project; nor shall.any person be required to pay any fee to any other person or agency for ob- taining employment for him on the project. No laborer shall be charged for any tools used in performing his duties except for reasonably avoidable lose or damage thereto. Every employee on the work shall be permitted to lodge, board and trade where and with whom he elects and neither the Contractor nor his agents nor his employees shall directly or indirectly require as a condition of employment that an employee shall lodge, board or trade at a particular place or with a particular person. No charge shall be made for any transportation furnished by the Contractor or his agents to any person employed on the work. No individual shall be employed as a laborer on the Project except on a wage basis, but this shall not be construed to prohibit the rental of teams, trucks or other equipment from individuals. No such rental agreement, or any charges for feed, gasoline, supplies, or repairs on account of such agreement, shall cause any deduction from the wages accruing to any em- ployee except as authorized by the regulations of the Secretary of Labor, under the "Anti -Kickback" Act, as amended, 18 U.S.C. 8749 4p u.S.C. Mo. The time allowed any hourly laborer shall be the period from the time such laborer is required to report for duty at the site of the work until re- leased cr permitted to leave the site of the work. No deductions from the time allowed any hourly laborer will be permitted for delays of lose than 30 consecutive minutes. An individual truck owner is a person who owns only one truck and operates it. A-3.1 Under any agreement made between the Contractor and an individual truck owner to hire his truck at any agreed rate per cubic yard mile, ton mile or on an Wwly basis, which agreed rate is to include income for services as driver of the truck, the total amount paid to the owner for the entire time the truck is earning truck rental shall be at least equal to the amount which would have been paid if the truck and the driver had been hired separ- ately for this same earning time at the minimum hourly rates for each as specified in these labor and truck rental provisions. A-3.2 An minimum rates listed in the following tabulations include compensation for all costs of operating the equipment except the operator's wages and workman's compensation insurance or any other assessments or taxes based on such wages. If, upon investigation of complaints or allegations of violation of the minimum wage rates contained in the Contract, such violation is found to be non -willful, the Contractor shall make immediate restitution to the affect- ed employee. B. If, upon investigation there is substantial evidence that the violations are willful or if the Contractor or any subcontractor without just cause refuses to make restitution, the Commissioner of Highways may withhold from any sums due or coming due to the Contractor under the Contract and pay directly to the employees employed by the Contractor or any subcontractor on the Project the difference between the amount due under the wage rates required by the Contract and the amount received by such employees. The Commissioner may also require the Contractor and any subcontractor there- after to submit to the Department of Highways certified copies of the week- ly payrolls and he may take such actions as are necessary to cancel the Contract and/or to declare the Contractor and any subcontractor eangaged on the Project ineligible to work on future highway projects for a period of two years or, in oases where Federal Funds are involved, for such other periods as are approved by the Bureau of Public Roads. S-17 (ib) LIQUIDATED DAMAGES In addition to the deduction for engineering costs specified in 1806, the State will deduct from any moneys due or coming due to lhe Contractor an amount equal to y50.00 per calendar day during the entire period from the Contract completion date until all work required by the Contract (ex- cept the operations specified in 1806 as being exempted from deductions for engineering costs) has been completed. S-18 TRAFFIC EWISIONS Restricted use of the highway by traffic shall be permitted in accord- ance with the provisions of 1707.2, except as modified below: S-18.1 Traffic will be routed over the present Roadbed until such time as the adjoining new Roadbed is oompleted, except for the asphaltic concrete binder and wearing courses.
