NESOWTION IN THE MATTER OF TIM PETITION TO VACATE AN USD STREET IN 'SUAURBANOALE ON FAKERS TAU SUBDIVISION, IN THE VILLWK OF PL1'll�DUTH, NENNBPIN COUNTY, MINNESOTA. WH6WW' r- Petition in the above -entitled matter was duly filed in the o.tYice of the Village Clerk of Plymouth, Minnesota, and W EREAS, the Village Clerk has caused Notices of a public hearing to be posted In three ;public places within the Village and a Notice of public hearing published in the Minnetonka Herald for the period of time of two weeks preceding the bearing on said Petition, and "WHIR8AS, the public hearing in said scatter was set for the first 'a day of September, 1959, at a regular meeting of the Village Council, and WNBRIAS, the matters set forth in tbe:Peti.tion appear to be true and correct, namely: 1. That Suburbandale on Parkers Lake is a duly platted subdivision in the Village of Plymouth, Hennepin County, Minnesota; that a plat thereof has been filed in the office of the Registrar of Titles in and for Hennepin J County, State of Minnesota. 2. That the petitioners petitioned for the vacation of The un -named twenty foot (T,O') Width roadway lying between Lot Eight (S) and Lot Nine (9), Block One (1), Suburbandale on Parker Lake and lying West (W) of Su=Lt Street in said subdivision (naw known as Leighton Road) -and to the bay on Parker'sLske. 3. .That petitioners, Frank H. Leighton and Esther Leighton, his wife, are the fee owners of the Lots and Blacks abutting upon'sad street to be vacated, and they are entitled to the ownershipof the abutting portion of the atreet to be vacated, 4. That said vacation is sought for the reason of the fact that the street is useless for the pyrppse of which said street Was laid out; that it serves no purpose as presently platted; that said street has never been improved for use as a public throughfare; that the cost to the municipality to open and improve the street proposed to be vacated would be an unjustifiable public expense. 5. That all tames against said land abutting said street to be vacated have been paid. 6. That it is to the best interest of the public to have said street heretofore described vacated.
