Ordinance No. 61-13
Ordinance Relating to Consump-
tion and Display of Intoxicating
Liquor and Imposing Addition-
al Fee Upon Holders of State
Licenses.
The Village Council of the Vil-
lage of Plymouth does hereby or -
dun as follows:
Section 1. Serving Set -Ups in
Unlicensed Places.
Section 1.01. It shall be unlaw-
ful for any proprietor of any pri-
vate club or public place of
business, other than a holder of
an intoxicating liquor license or
a permit issued by the State
Liquor Contro7 Commissioner
pursuant to Chapter 735, Laws of
1961, and payment of the addi-
tional fee prescribed in Section
2 below, to permit the consump-
tion or display of intoxicating
liquors upon such premises, or
in any manner to serve or to per-
mit the serving of liquids for the
purpose of mixing with intoxi-
cating liquor.
Section 2. Additional Fee to be
Paid by Holder of Stag Liquor
Control Permit.
Section 2.01. There is hereby
imposed upon the holder of State
Liquor Control permits, issued
pursuant to Chapter 735, Laws of
1961, M.S.A. 340.14, an additional
,fee of IM per annum. Such fee
shall be paid to the Village Clerk
of the Village of Plymouth on or
beforg,JuIX Isl of each year and
a receipt given therefor. Not-
withstanding that a portion of the
year may have elapsed when such
payment is made, there shall be
no pro rata adjustment of said fee.
Section 2.02. Section 2.01 above
apply equally to religious or non-
profit corporations or associations
except that the additional fee to
be paid by such corporations or
associations shall be the sum of
$10 per annum.
Section 2.03. The written re-
ceipt referred to in Section 2.01
above shall be posted in some
conspicuous place upon the prem-
ises alongside the permit issued
by the Liquor Control Commis-
sioner and shall be kept posted at
all' times.
Section 3. Limhation on the
Consumption or Display of In.
toxicating Liquors and Inspection.
Section 3.01. No person shall
consume or display or allow con-
sumption or display of intoxicat-
ing liquor on any premises of a
private club or public place be-
tween the hours of 1:00 am. and
8:00 a.m., or between the hours
of 1:00 am. and 3:00 p.m, on
Memorial Day, or between the
hours of 1:00 am. and 8:00 p.m.
on any primary, special, or gen-
eral election day.
Section 3.02. Any private club
cr public place allowing the con-
sumption or display of intoxicat-
ing liquor shall be open at all
reasonable hours for inspection by
the Liquor Control Commissioner,
his designated agents and duly
authorized peace officers of the
village. Refusal to permit such
inspection shall be a violation of
this ordinance.
Section 4. Penaltim
Section 4.01. Any person vio-
lating the provisions of this ordi-
nance shall be guilty of a mis-
demeanor and upon conviction
shall be punished by a fine of not
more than $100 and costs of prose-
cution, or by imprisonment of
not to exceed 00 days.
Section L ESeetive Date.
Section 5.01. This ordinance
shall become effective upon its
publication.
