PROVIDING FOR THE SAFETY AND COMFORT OF PERSONS USING WA - T E R W A Y S: PROiIIBRiNG UNAUTHORIZED USE OF WATERCRAFT: REQUIRING CLEANLINESS ON WATER. WAYS: AND PRESCRIBING PENALTIES FOR THE VIOLA. TION OF ITS PROVISIONS. Be it ordained by the Village Council of the Village of Plym- outh as follows: Section 1. Chapter ail Minne- sota Statute Incorporated. The provisions of Chapter 361 of Min- nerota Statutes, as amended are hereby adopted and incorporated herein and made a part hereof by reference, as fully as if set forth herein. Section L Operating of Water- crafL All watercraft operated, underway or in use shall be equipped and operated as follows: Subd. (a). When operated, un- derway or in use between sunset and sunrise shall be equipped with and have in operation red and green running lights in the for- ward section of the boat, and a white light at the stern or on the super structure; which white light shall be visible on a dark night with clear atmosphere for a dis- tance of 2 miles from any direc- tion. Provided, however, that mo- tor powered watercraft under 16 feet in over-all length may use portable lights, which must be clamped on the watercraft when in use; and, non -powered water- craft may use a portable single white light which is visible from any direction for a distance of 2 miles on a dark night with clear atmosphere. Subd. (b). When at anchor or drifting must show a white light visible from any direction for a distance of one mile and such light shall be lit from sunset to sunrise, except that a watercraft anchored at a cove, within 100 feet of shore and 200 feet away from normal navigation and any watercraft anchored at a dock or pier need not have the white light lit. Subd. (c). Shall have on board and readily accessible, life pre- servers, vests, or other similar buoyant devices capable of keep - :ng every person on board afloat. Subd. (d). Shall not use or dis- play a red light, except a red running light. This subdivision dues not apply to authorized wa- ter patrol boats or other police watercraft. Subd. (e). Shall not use or dis- play a police, sheriff, or law en- forcement officer's flag, or any device designed to simulate a flag. This Subdivision does not apply to authorized water patrol boats or other police watercraft. Subd. (f). No person under 15 years of age shall operate a wa- tercraft powered by a motor of 10 horsepower or more, unless ac- companied by a competent per- son 15 years of age or older. Section 3. Towing. No person being towed or operating a water- craft towing one or more persons behind a watercraft on water- skis, aqua -plane, s u r f b o a r d, saucer, or similar device shall tow or be towed unless: Subd. (a). The person towed is wearing a life vest, belt or other buoyant device, except with writ- ten permission of the County Sheriff. Subd- (b). Not more than two (2) persons are towed by the same watercraft at the same time, ex- cept with written permission of the County Sheriff. Subd. (e). The person towed is towed not later than one-half hour after official sunset and not earlier than sunrise. Subd. (d). The towing rope, cable or other towing device be not longer than 85 feet, except with written permission of the County Sheriff. Subd. (e). The towing water- craft and the person towed are at all times distant at least 150 feet from any bathing area, skin diver's warning flag, swimmer, raft, watercraft, dock or pier, ex- cept that raft, dock, or pier from which he is operating. Subd. (f). During a holiday, Saturday or Sunday or in a con- gested area at any time, unless two competent persons are on board the watercraft, the driver of such watercraft shall be at least 15 years of age and must watch where the watercraft is being driven at all times. The second person aboard the water- craft shall be an observer, and shall be at least 12 years of age, and shall watch the person or per- sons being towed at all times. Subd. (g)• Unoccupied tow fuses are taken from the water within a reasonable length of time. Subd. (h). Those persons tow- ing or being towed refrain from towing into or through a marked channel connecting two bodies of water. Suction 4. Dangerous Opera- tion. No person shall operate any water craft, or other boat, auto- mobile, vehicle or powered pro- pelled device on the open water. o: upon an ice -covered body of water in such a manner as to en- danger life, limb or property. Section L Unauthorised Us& No person shall board, use, dam- age, or tamper with a watercraft, or other boat, except when done by the owner or with the owner's consent. Section 6. Abandoned Water- craft. Every watercraft or other boat in a waterway which is aban- doned or becomes a menace to navigation, or is unseaworthy, or sinks, grounds, or becomes other- wise disabled, is hereby declared to be a nuisance and the person in charge thereof shall abate such nuisance within 10 days atter no- tice from the Chief of Police. Section 7. Cleanliness — Wa- terways. All persons owning or operating a watercraft or other boat upon a waterway shall ob- serve all the health and sanitary regulations of the village and all ordinances o fthe village relating to conduct of persons, and pro- hibiting acts contrary to said ordi- nance. No person in charge of or occupying a boat shall dump garbage, papers, bottles, cane, refuse or debris into waterways. Section t. Cleanliness — Docks. Persons in charge of or operating boats shall at all times keep the docks and sea-walls and premises adjacent to such watercraft or boats in a neat and orderly man- ner and free from trash, rubbish, repair parts, machinery, equip- ment and debris of all kinds. Section 9. Penally. Any viola- tion of this Ordinance is deemed a misdemeanor and a violation thereof is punishable by a fine not to exceed $100.00 or imprison- ment not to exceed ninety (90) days.
