HomeMy WebLinkAboutCity Council Ordinance 1960-05RESOLUTION NO. 60.5 Establidd q a Munidpal Court in no Village ON P*Routh, K". nepio Countr, Wkwasola WHEREAS, Chapter 660 of the Laws of the State of Minnesota of 1859, provide for the establish- ment of a Municipal Court in each Village without a municipal court which has 1,000 or more inhabi- tants, and WHEREAS, it is the desire of a four -fifth (4/5) majority of the Village Council of Plymouth that such a municipal court be estab- lished in accordance with said Statute, NOW, THEREFORE, BE IT RE- SOLVED by the Village Council of the Village of Plymouth, Min- nesota, meeting in regular session at the Village Hall on the 98th day of April, 1960, with all mem- bers present. as follows: 1. That ■ municipal court for the Village of Plymouth be estab- lished w i t It accordance with Chapter 860 of the State Laws of Minnesota, passed in 1959. L The place for the session of the court shall be at the Village Hall or at the Beacon Heights School, or some other satisfactory public building. 3. The number of judges of said court shall be one (1) . 4. The salary and appropria- tions for the court shall be in accordance with the statute. 5. That the clerk of the Plym- outh Municipal Court shall be Philip P. Halbert and the clerk's salary is hereby established at Thirty-five ($35.00) Dollars per month. 6. Members of the police depart- ment of the Village of Plymouth are hereby authorized to remove a vehicle from a street or highway to the nearest garage or other place of safety, or to a garage des- ignated or maintained by the police department, or otherwise maintained by this Village under the etrcumstancee hereinafter enumerated. (1) When any vehicle is left unattended upon any bridge, via- duct, or causeway, wbere such vehicle constitutes an obstruction W traffic. (2) When a vehicle upon a highway or street is so disabled as to constitute an obstruction to traffic or the person or persons in charge of the vehicle are, by rea- son of physical injury, alcohol, narcotics, incapacitated to such an extent as to be unable to provide for its custody or removal. (1) When any vehicle is left unattended upon a street or high- way and is so parked illegally as to constitute a hazard or obstruc- tion to the normal movement of traffic. section -Z. Whenevio an officer removes a vehicle from a street as author- ized under Us Ordinance and the officer knows or is able to amm- tain from the registration records in the vehicle, the name and ad- dress of the owner there4 such officer shall immediately give or cause to be given notice in writing to such owner of the tact of such removal and the reasomt therefor and of the place to which said •. chicle has-been removed. In the event such vehicle is stored in a public garage, a copy of such no- tice shall be given to the proprie- tor of such garage. Section 3.
