HomeMy WebLinkAboutCity Council Ordinance 1959-19L'9 -/), VILLAGE OF PLYMOUTH An Ordinance Concerning the Collection and Disposal of Gar- bage and Rubbish and Provid- ing for the Licensing of Gar- bage and Rubbish Collectors The Village Council of Ply- mouth do ordain as follows: SECTION 1. It shall be unlaw- ful for any person, firm or cor- poration to fail to dispose of gar- bage and rubbish which may be or may accumulate upon proper- ty owned or occupied by him or them in a sanitary manner at least as often as provided in section 10 hereof. Every person, firm or corporation who shall fail or refuse to make provision for and secure such disposal shall be guilty of a misdemeanor. Per- sons desiring to make use of the services of licensed garbage and rubbish collectors may do so by notifying such collector and pay- ing the fees provided for herein. SECTION 2. The word "gar- bage" as used herein shall in- clude only organic refuse result- ing from preparation of food, and decayed and spoiled food from any source. The work "rubbish" as used herein shall include all inorganic refuse matter such as tin cans, glass, paper, ashes, sweepings, etc. 1 SECTION 3. Every household- er or occupant of any dwelling house, boarding house, restaurant or any place of business, having garbage to dispose of, who does not otherwise provide for the disposal of such garbage in a sanitary manner, shall provide himself with one or more fly tight metal cans sufficient to receive all garbage which may accumulate between the times of collection. Each can shall be provided with a bail or handles and a tight fitting cover. SECTION 4. All garbage and rubbish accumulating between the times of collection shall be placed in the cans provided for in section 3, hereof. SECTION 5. Garbage cans shall be kept at or near the back door or garage of the building using the same or at the rear of the property if there is an alley and shall be accessible to collect- ors at all reasonable times. SECTION 0. It shall be unlaw- ful for any person, firm or cor- poration to collect garbage with- out having first secured from the council a Iicense so to do. SECTION 7. Any person, firm or corporation desiring a license to collect garbage shall make application for the same to the clerk upon a form prescribed by the council. The application shall set forth (1) the name and address of the applicant; (2) a list of the equipment which he proposes to use in such collection; (3) the place or placers to which the garbage is to be hauled (4) the manner in which said garbage is to be disposed of and (5) the portion of the village in which collections are tr be made. Said application shall be submitted to the health officer for his investigation and report. If the health officer finds that the applicant is responsible and has proper equipment for such collection and that no nuisance is liable to be created by the granting of said license, he shall endorse his approval upon the application. Before any license may be issued, the appli- cant shall, if his application is approved by the council, deposit with the clerk a surety bond in the penal sum of One Thousand ($1,000.00) dollars conditioned that lie will f-ithfully and continuous- ly pro- _ie the garbage collection service specified in his application as modified by the council and under the conditions imposed by the ordinances of the village and the lawful orders, rules and reg- ulations of the health officer. If such surety bond is approved by the council, the clerk shall issue and deliver the license. A license fee of Twenty-five ($25.- 00) dollars shall accompany the application and upon granting the license the fee shall be de- posited in the general fund. No license issued hereunder shall be for a longer period than one year, and all licenses shall expire on April 1, of each year. SECTION 8. Each licensed garbage collector shall provide a covered tank or wagon, so constructed that the contents will not leak or spill therefrom, in which all garbage collected by him shall be conveyed to the place des'.gnated in his applica- tion. The wagon or conveyance used shall be kept clean and as free from offensive odors as possible, and shall not be allow- ed to stand in any street, alley or public, p;nre longer than is reasonably nece;gyary to collect garbage. SECTION 9. The expense of garbage collection shall be paid to the collector monthly, by the owner, agent, occupant, or tenant of the premises from which such garbage is collected, snd such fee Zhall be full compensation for his scrvices in such collection but in no case shall the fee charged for such collection ex- ceLd maximum sums set by the Village Council, provided that if the tenant or occupant of the property shall fail to pay said expense, the owner shall be liable therefor to the collector. The collector may refuse to make collection from any premises when the fees provided for herein are not paid within 30 days from the date when due. The collector shall notify the health officer and the chief of police of the discontinuance of such service to any premises within two days after service is discontinued. SECTION 10. Each licensed garbage collector shall make col- lections, ir, that portion of the village in whi,-!, he is licensed to collect, wr-0 am residences and semi-wer from hotels, restaurants, b�.u: hng houses, etc. SECTION 11. Every household- er or owner, occupant or tenant of any premise who does not otherwise dispose of rubbish in a sanitary manner, shall place all rubbish in a tight receptacle. It shall be the duty of each licensed garbage collector to collect and haul away once each month to such place as may be designated by the health officer, all such rubbish from premises located within the area in which he is authorized to collect gar- bage. He may charge for such service to the owner or occupant of the premises not to exceed a rate per bushel for such rubbish removed as set by the Village Council. SECTION 12. Any person, firm or corporation violating any of the provisions of this ordin- ance shall upon conviction there- of be deemed guilty of a misde- meanor and punished by a fine of not more than one hundred dollars or by imprisonment in the village or county jail for not more than ninety days. SECTION 13. This ordinance shall be in full force and effect from and after its passage and publication according to law. Passed by the Village Council this 15th day of September, 1959. Howard C.
