Including the Operation of a Kiddieland Amusement Park in the Village of Plymouth and Providing a Penalty for the Violation Thereof. ine Council of the Village of Plymouth do ordain as follows: Section 1. The maintaining and operation of a theatrical perform- ance, stage shows, moving pic- tures, drive-in theatre, amuse- ment parks, are hereby declared to be a public nuisance, and are prohibited for operation within the Village of Plymouth except ns hereinafter provid-d for. Section L Theatrical perform- ances, stage shows, moving pic- tures, drive-in theatres, amuse- ment parks, are defined as forms of entertainment to which two or more persons are invited to view an exhibition of acting or the screen projection of motion pic- tures with accompanying sound broadcasting, or the furnishing of rides to the public, for a profit or in the course of a business en- te-prise. Section 3. Nothing contained herein shall prevent theatrical presentations and motion pictures by religious and educational non- profit associations or corporations within the confines of a church or religious education edifice or within a public school building, where the presentation is spon- sored by religious or educational or non-profit group. Section 4. That no theatrical performance, stage show, moving picture and drive-in theatre and amusement park shall be erected, maintained, or operated within the village of Plymouth without a license therefor having been obtained from the Village Council by the owner or proprietor there- of. Such license shall in all cases expire on the 31rt day of Decern- her next after the date of issue. Applications for such license must be made in waiting to the Village Clerk. The annual license fee shall be $50.00 per year, payable in advance. The Village Council may at its discretion prorate the license fee on a monthly basis. Section L That any operator or owner of an exhibition or amuse- ment park licensed under this or- dinance shall conduct said prem- ises and said operations in a law- ful manner. He shall comply with P11 regulations and statutes of the State of Minnesota. He shall not maintain any nuisance or noise on said premises, and shall at all times keep the premises clean, allow no trash, paper cups, papers or wrappers to be scattered on -aid premises. He shall allow no bottles, bottle caps or metallic art�cles to be deposited or allowed to lay on the driveways, parking areas and walkways on the prem- ises. That he shall not permit any intoxicating liquors or any im- moral conduct or practices to ex- ist on said premises. That suffic- ient parking facilities shall be made available to adequately take care of all patrons and that no motor vehicles shall be allowed to stop or park on the shoulders of the public highway in the im- mediate vicinity of said premises. Section 6. That each licensee shall deposit with the Village Clerk a crartificate of insurance in- &cating that the licensee has a policy of public liability insur- ance to protect the public and in such amounts as the Council may require, The Council may revoke the license, after notice, upon vio- lation of this ordinance. Section 7. Whoever in any man- ner vioIRtes or fails to comply with an,, of the terms of this ordi- nance shall be punished by a fine of not more than $100.00, or be imprisoned for not more than 90 days.
