The Village Council of the Vil- lage of Plymouth do hereby or- dain as follows: Section 1., This Ordinance shall be known as "The Streets and Sidewalk Ordinance." Section 2, Excavations In Pub- lic Thoroughfares Section 2.01. It shall be unlaw- ful for any person, firm or corp- oration hereafter to dig or exca- vate in any street, alley, or public highway in this village for any purpose whatsoever without first having received a written permit from the Village Council. Section 2.02. Such permits shall b- a-irted only upon the written application of the person, firm, or corporation, contemplating such digging or excavation or author- izing the same and such applica- tion shall be accompanied by a fee in the amount of 01.00 cover- ing the costs of inspection and is- suance, such fee to be paid to the treasurer of the Village. Section 2.08. Such permits shall contain such conditions as seem At to the Council of the Village and, in addition, every such per- mit shall contain the following provision, which provision shall be binding upon the applicant: "This permit is granted sub- ject to the provision that the holder thereof shall save the Village harmless from any dam- ages that may result from such digging or excavation. No viola- tion of the terms of this permit shall be construed as binding the Village, expressly or Impliedly, to any agreement in contraven- tion of the terms of this permit or of the provisions of the Ordi- nance under which it is grant- ed." Section 2.04. The Council may, as a condition precedent to the granting of any permit under this Ordinance, require the anplicant to post a bond in an amount not exceeding $1,000.00, which bond shall run to the Village and whose terms shall save the Vil- lage harmless from any and all damages suffered by any party by reason ,f such digging or excava- tion. Section', Protection of Streets, Sidewalks and Alleys. Section 3.01. No person shall erect, build, set up or maintain anoy house, store, shop or other building or structure in or upon any street, sidewalk, avenue, al- ley, lane or public ground within the limits of said village; no per- son shall deposit or place and leave any box, merchandise, tim- ber, plank, board, shingle, cask, barrel, hogshead, lumber, brick, stone, truck wagon, sled or car- riage in or upon any street, side- walk, avenue, alley, lane or pub- lic lrouud within the limits of said village; nor shall any person suffer or permit ary pine or other wood to drop from carts or wa- gons or other vehicles while transporting the same t h r o u g h any sheet in said village and per- mit th,� same to r,main therein or thereon; nor shall any person deposit any offai, filthy water, garbage, dirt or any other ma- terial or substance whatever in or upon any street, sidewalk, ave- nue. alley, lane or public ground within the limits of said village. Section 3.02. Any person or persons building or repairing any building near any street. avenue, alley or public ground in said village, or desirir-1 to rkmove any building along any street or street9 of said village, shall ap- ply to the Village Council for a perm!t to place building material upon such street, lane, avenue, al- ley or public groupd during the process of such building; and the Village Council may grant such permit under such conditions and restrictions to be set forth in such permit as will prevent need- less inconvenience. ProviciW, that no such permission shall be given to any person to occupy with such material more than one-third of the roadway of such street, nor to permit such obstruction to remain in said street or alley more than three months. Section 3.08. Any excavation in a street, sidewalk or public ground shall be protected by suit- able guard or fence to prevent injury to persons and animals by falling therein. Every person making such excavation, when it is accomplished. or when orderrd by the Village Council, shalt. without delay, fill the same so that it shall be in as goad condi- tion as before said excavation. Section 3.04. No person shall saw any wood or pile the same on any sidewalk of any street in said village. Soetion 3.05. Nn person shell wantonly mar, inure, deface or destroy any fence, guide post, sign board, awning, lamp post, lamp or lantern in any street square or public place in said vile-ige. Section 3.06. No person sh-11 rut down, remove injure or destroy any fruit, shade or other trees or flowers or shrubbery growing or being in any public street, l alley, common or otlfer Pelt e grounds in said vffla�e rri164ttt the permission of the Village Council, and no person shall fas- ten any horse or other animal to any such tree. Section 3.07. No person or per- sons shall place, leave, throw, drop or seatt^r in or upon any street. Lvenue or alley any glass, crockery, scrap iron, nails, tacks, or any other articles or things which would be liable to injure or damage the tires of vehicles or automobiles, motorcycles or bicycles, or any other vehicles which have wheels with rubber or pneumatic tires. Section 3.08. No person or per- sons shall place, leave, throw, de- posit, or drop or cause or permit to be placed, left, thrown, de- posited or dropped any crude pe- troleum, kerosene, gasoline, nap- tha, benzine, spirits of turpentine, or any coal, rock. or earth oil in or upon any street, avenue or alley within the corporate limits of the Village of Plymouth. Section 3.00. No person or per- sons shall drive any vehiele over or serosa any sidewalk from any street to any lot or from any lot over or across any sidewalk to a street or avenue, except a re a- larly constructed driveway, which driveway shalt be appso, by the Village Council of the VU - last of Plymouth. %- etiyx 3:10.
