RESOLUTION No. 2013-063
A RESOLUTION APPROVING A VARIANCE FOR PAULY ENTERPRISES, INC.
TO ALLOW OFF-SITE SIGNAGE AND SIGNAGE THAT WOULD EXCEED THE
MAXIMUM ALLOWABLE SIZE TO BE LOCATED AT 2945 EMPIRE LANE

WHEREAS, Pauly Enterprises, Inc. owns and operates Plymouth Tire and Auto
Service/Goodyear located at 2995 Harbor Lane; and
WHEREAS, Pauly Enterprises, Inc. has requested approval of a variance to allow off-site
signage and signage that would exceed the maximum allowable sign area to be located on the
Perkins Restaurant site located at 2945 Empire Lane; and
WHEREAS, the proposed sign would be located on property legally described as Lot 4,
Block 1, Plymouth Freeway Center Addition, Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Pauly Enterprises, Inc. for a variance to allow off-site signage and signage that would
exceed the maximum allowable sign area to be located on the Perkins Restaurant site located at
2945 Empire Lane, subject to the following:
1. The requested variance is hereby approved, in accordance with the application
materials received by the city on October 26, 2012 and January 4, 2013, except as
may be amended by this resolution.
2. The requested variance is approved, based on the findings that all applicable variance
standards would be met, the private easement allowing the sign has been in place
since 1976, and the total sign area would be reduced by roughly 52 square feet.
3. Prior to installation of the sign, a sign permit and an electrical permit are required.
The applicant must also demonstrate that the existing pylon is capable of supporting
the proposed sign.
4. The property at 2995 Harbor Lane shall not be allowed to have a freestanding sign as
long as a sign for the business at 2995 Harbor Lane (Goodyear site) is displayed on
property located at 2945 Empire Lane (Perkins site).

5. The variance shall expire one year after the date of approval, unless the property
owner or applicant has commenced the authorized improvement or use, or unless the
applicant, with the consent of the property owner, has received prior approval from
the city to extend the expiration date for up to one additional year, as regulated under
section 2 103 0. 06 of the zoning ordinance.
