EXTRACT OF MINUTES OF REGULAR MEETING
OF VILLAGE COUNCIL OF
VILLAGE OF PLYMOUTH, MINNESOTA
February 16, 1970
Pursuant to due call and notice thereof a regular
meeting of the Village Council of the Village of Plymouth was
held on February 16, 1970 at the Village Hall, 13800 State
Highway No. 55, ccmmencing at 7:30 o'clock p.m. The following
it members were present: Mayor Hilde, Councilmen Hintz, Johnson
+{ Kindseth and Spaeth. The following members were absent: None.

Councilman Spaeth introduced the following
resolution and moved its ae ption:
"RESOLUTION NO. 70-65
A RESOLUTION WAIVING THE REQUIREMENTS
OF SECTION 9.02 OF CHAPTER VII OF THE
SUBDIVISION ORDINANCE RELATING TO
CONVEYANCE BY METES AND BOUNDS OF
PARCELS OF LAND OF LESS THAN FIVE ACRES
WHEREAS, the Village of Plymouth has recently acquired
for park purposes certain lands in Section 5, Township 118,
Range 22 from Mr. and Mrs. William Egan, and
WHEREAS, following such conveyance Mr. and Mrs.
William Egan continued to own a small parcel of land
adjoining said land conveyed to the Village of Plymouth, and
WHEREAS, said Mr. and Mrs. William Egan desire to
convey said remaining parcel to Mr. Howard L. Hunt, and
WHEREAS, said remaining parcel contains less than
five acres in land area and the conveyance of which would be
prohibited by Section 9.02 of Chapter VII of the Village Code
without a waiver of such provision by the Village Council.
NOW THEREFORE BE IT HEREBY RESOLVED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS:
1. The provisions of Section 9.02 of
Chapter VII of the Plymouth Village Code
relating to the conveyance by metes and bounds
of parcels of land having an area of less than
five acres are hereby waived with respect to
the following described parcel?
That part of Section 5, Township 118,
Range 22 described as follows: Beginning
at a point in the North line of the
South 1/2 of the Northwest 1/4 of said
Section 5 distant 385 feet East from the
centerline of Elm Creek; thence East
along said North line 126 feet; thence
deflect 90 degrees 57 minutes right
691 feet; thence deflect 89 degrees 3 minutes
right 126 feet; thence deflect 90 degrees
57 minutes right 691 feet to the point of
beginning except road.
2. The Village Clerk is directed to furnish
i; a certified copy of this resolution to the owners
of said parcel for recording purposes."
The: abode motion was seconded by Councilman Johnson
and upon vote being taken thereon the following voted in favor
thereof: Mayor Hilde,Councilmen Hintz, Johnson, Kindseth and
Spaeth. The following voted against: None.
Whereupon said resolution was declared duly passed and
adopted.

I, the undersigned, being the duly qualified and acting
Village Clerk of the Village of Plymouth, Minnesota, herby
certify that I have carefully compared the attached and fore- I
going extract of minutes of a regular meeting of the Village
Council of said Village held February 16, 1970 with the original
thereof on file in my office and the same is a full, true and
complete transcript therefrom insofar as the same relates to
waiving the requirements of Section 9.02 of Chapter VII of the
subdivisbn ordinance relating to conveyance by metes and bounds !
of parcels of land of less than five acres. +�
