HomeMy WebLinkAboutCity Council Ordinance 1987-33CITY OF PLYMOUTH ORDINANCE NO. 87- 33 AN ORDINANCE AMENDING PLYMOUTH CITY CODE, BY REPEALING SECTION 915.13 AHD A14EN(7TIJ1'; SECTION 915.09 RELATING TO KENNELS THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Plymouth City Code, Section 915.13, Subdivision 3. Unlicensed Kennels, is hereby repealed. Section 2. Plymouth City Code, Section 915.09, Subdivision 5., Kennels; Zoning, is hereby amended to read as follows: Kennel licenses may only be issued [as] in conjunction with a Conditional Use Permit[s] for a kennel in the [R-0] FRD zoned areas within the City. Associated Zoning Administration Fees shall he paid by the applicant prior to Planning Commission consideration of the Conditional Use Permit and license. Section 3. Effective Date. This Ordinance shall take effect upon Its passage and publication. Adopted by the City Council the 7th day of December , 1987. Willis FROM: Community Development Director Blair Tremere SUBJECT AMENDMENT OF CITY CODE REGARDING KENNELS SUMMARY: The attached Ordinance amends the City Code in two places re- garding dog kennels. One amendment eliminates a redurdent pro- vision which is unnecessary because of existing language in the same Section. The other amendment clarifies the zoning status for kennels. The redundent section was brought to the City Clerk's attention by the City Attorney's office following adoption of a recent Code amendment regarding the age of dogs. The City Attorney's office recommended that this portion be repealed since it not only conflicted regarding the age of dogs, but also was unnecessary because kennels are required elsewhere in the same section. The other part deals with the zoning. The R -O district which is referenced was eliminated several years ago in favor of the current FRD (future restricted development) District. Language is also recommended which would clarify the relationship of kennel licenses and the required Conditional Use Permit. Attachments 1. Draft Ordinance 2. Existing Code
