ORDINANCE NO. 85-30
AN ORDINANCE RELATING TO PUBLIC SAFETY;
AMENDING CHAPTER 915 OF THE CITY CODE
REGARDING ANIMAL CONTROL
THE CITY OF PLYMOUTH DOES ORDAIN:
Section 1. Section 915.01 of the City Code is amended
by amending Subdivision 4 and by adding Subdivision 6 thereof
as follows:
"Subd. 4. "Under restraint" means (i) controlled
by a fence, lease or owner's command within the
confines of the owner's property or (ii) by a
leash not exceeding six feet in length while
outside of the owner's property and under the
control and direction of the owner or a member
of the immediate family, so as to be effectively
restrained, or (iii) within a vehicle being
driven or parked on a public street.
Subd. 6. "Fierce, dangerous and vicious" means
any dog which, outside the owner's premises,
molests pedestrians, bites a human being, attacks
another dog or domestic animal, or jumps upon a
person, or which, anywhere in the City, attacks
a human being causing great bodily harm."
Section 2. Section 915.09 of the City Code is amended
by amending Subdivision 6 as follows:
"Subd. 6. Issuance of License. No kennel license
or renewal shall be issued except upon action
of the City Council following review of the
kennel license application by the ehief-e#-Pe+tee
Director of Public Safety and Planning Commission."
Section 3. Section 915.11 of the City Code is amended
as follows:
"915.11. Begg-Prohibited-frein-Banning-at-targe-
Violations and Impoundment.
Subd. 1. Genera}-stn}e- Dogs Prohibited from
Running at Large. No owner shall permit a dog
to be at large within the City. and-sha}}-keep
the -deg -ander -restraint -at -a}} -times:
Subd. 2. eertnin-dogs-ne-eNaer-sha}}-a}}eFr_a
fe:nn}e-deg-in-heat-er-a-fierce=-dangerens-er

deg-is-fierce;-dangerens-er-bieieas: Dogs to Be
Kept under Restraint. An owner shall keep the
dog under restraint at all times.
Subd. 3. Impoundment of Fierce, Dangerous or
Vicious Dogs. The ehief-ef-Pe}see Director of
Public Safety is hereby authorized to impound
any fierce, dangerous or vicious dog endangering
the safety of the general public or animal life."
Section 4. Section 915.15 of the City Code is amended
by amending Subdivision 2. as follows:
"Subd. 2. Enforcement. It shall be the duty of
the ehief-a+-Pe+tee Director of Public Safety
together with the person or persons designated
by the City Council as the Beg-eateher-er-Anima}
Warden Animal Control Officer to enforce the
provisions of this Section and to transport or
cause to be transported to the City pound any or
all dogs kept within the City contrary to the
provisions of this Section. The Beg-eateher-er
Anima} -Warden Animal Control Officer is authorized
to issue tags and sign complaints against any
person for violation of the provisions of this
Section."
Section 5. Section 915.17 of the City Code is amended
by amending Subdivision 1 and Subdivision 2 as follows:
"6ubdivisien Subd. 1. Notice. Whenever any person
owning, possessing or harboring any dog within
the City shall learn that such dog has bitten any
human being, such person shall immediately notify
the ehfef-ef-Pefiee Director of Public Safety.
Subd. 2. Impoundment. Whenover the ehfef-ef
Pe+iee Director of Public Safety shall learn
that any human being has been bitten by a dog
in the City, he shall ascertain the identity
of such dog and the person owning, possessing
or harboring it, shall .immediately direct such
person to forthwith impound such dog as herein
required. Provided Eiat if such dog has bitten
a human being while in the premises of its owner
and said dog is currently licensed and vaccinated
against rabies infection, the ehfef-ef-Pe+iee
Director of Public Safety or Anirmei-Warden
Animal Control Officer may permit the dog to be
impounded upon the premises of its owner pro-
vided that it is kept apart from members of the
general public during such impoundment period.
If under the circumstances the dog is not
currently licensed the ehfef-ef-Pe+iee Director
of Public Safety or Animni-Werden Animal Control
Of if cer may permit the owner of suc dog to
immediately obtain a license therefor paying
all fees required including late licensing fees.
The impoundment fee for any dog that is impounded
in the City pound a second time for biting a
human being shall be double the regular impound-
ment: fee provided elsewhere in this Code. The
ehX'ef-ef-Pe+iee Director of Public Safety shall
order and direct the transport of such dog to
;:he city pound. Any dog so impounded shall be
kept continuously so confined for a period of
ten days after the day the dog bit a human being.'
Section 6. Section 915.21 of the City Code is amended
as follows:
11915.18. 9nngereas-Anirnnis- Destruction of Dangerous
Animals.
Subd. 1. Befined: City Manager Authorized. The
City Manager or his authorized designee is authorized
to order the destruction or disposition of any

animal which he determines to be fierce, dangerous
and vicious as defined in this chapter. The City
Manager, after having been advised of the existence
of such an animal, shall proceed in the manner pre-
scribed by this subsection."
Section 7. Section 915.21 of the City Code is amended
by amending Subdivision 2 as follows:
"Subd. 2. Trapping Prohibited; Platted Areas.
All trapping on private property withinthin or upon
platted lands in the City is prohibited except:
(a) when the owner of such private property
has expressly consented to allow trapping
thereon; and
(b) Upon the issuance by the ekief-ef-Pe+tee
Director of Public Safety of a permit
therefore after a showing that such trapping
is necessary to eliminate a nuisance."
Section 8. This ordinance shall take effect upon its
passage and publication.
