HomeMy WebLinkAboutCity Council Ordinance 1982-26'i AN ORDINANCE AMENDING 1980, AS AMENDED, AND THE CITY COUNCIL AS FOLLOWS: CITY OF PLYMOUTH ORDINANCE NO. 82-26 PORTIONS OF THE ORDINANCE 80-09, ADOPTED JUNE 16, KNOWN AS THE PLYMOUTH ZONING ORDINANCE OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN Section 1. Amendment of Ordinance. SECTION 4, Subdivision B, its hereby amended in part to read as follows: Dwelling -- Any building or any portion there of which is not an "Apartment", "Lodging House", "Manufactured Home", or a "Hotel" as defined in this Section, which contains one or twe more "Dwelling Units" or "Guest Rooms" used, intended, or designed to be built, used, rented, leased, let, or hired out to be occupied, or which are occupied for living purposes. Section 2. SECTION 4, Subdivision B, is hereby amended in part by the deletion of the following in their entirety: Mobile Home Mobile Home Park Modular Manufactured Recreation Vehicle or Pre -fabricated Home Section 3. SECTION 4, Subdivision B. is hereby amended in part by ,the addition of the following: Manufactured Home -- (Class I) - A structure, transportable in one or more sections which in the traveling mode is eight body fee' or more in width, or forty body feet or more in length, or, when ert-ted on a site, is 320 or more square feet; which is built on a perman,nt chassis and designed to be used as a dwelling with a permanent foundation, unless otherwise specifically provided by this Ordinance, when connected to the required municipal utilities; and which includes the plumbing, heating, air conditioning, and electrical systems contained therein; except that, the term includes any structure which meets all the require- ments, with respect to which the manufacturer voluntarily files a certification, required by the Secretary of the Federal Department of Housing and Urban Development, and which complies with the standards set forth in Minnesota Statutes 327.31 to 327.35 Manufactured Homes are subject to the requirements of the "ManufactLired Home Building Code" as set forth in those statutes and in the "Rules for Manufactured Homes" set forth in 2 MCAR 1.90100 through 1.9G900. Class I Manu- factured Homes shall have a minimum width of 22 feet, as measured at the narrowest dimension when located on an appropriate site as provided by this Ordinance. Manufactured Homes are subject to the requirements and standards set forth in this Ordinance as to location, foundatior;, and standards for residence districts. Manufactured Homes for purposes of this Ordinance do not include "recreation vehicle" or ";n-ldular, prefabricated, and manufactured buildings and structures" as iefined in this Section. f Page two Ordinance No. 82-26 Manufac gyred Home -- (Class II) - A structure of less than 22 feet in width as measured at the narrowest dimension when located on an approp- riate site as provided by this Ordinance; and which otherwise is subject to the same definitions, laws, regulations, standards and exclusions as set forth in this Section for Class I Manufactured Homes. Manufactured Home Park -- A development consisting of a site, lot, parcel, or tract of land upon which two or more Class I and/or Class II Manufactured Homes are harbored, either free of charge or for revenue purposes; including any building, structure, tent, vehicle, or enclosure used or intended for use as part of the equipment of such Manufactured Home Park; subject to the location requirements and desion standards as set forth in this Ordinance; and subject to the requirements and standards set forth for Manufactured Home Parks in Minnesota Statutes Chapter 327 and State regulations pursuant thereto. For purposes of this Ordinance the term does not include "Recreational Camping Area" as defined in Minnesota Statute 327.14, Subd. 85. Modular, Prefabricated, and Manufactured Buildings and Structures -- Buildings and structures which are made or assembled in manufacturing facilities, on or off the building site, for installation, or assembly and installation, on a permanent foundation on the building site; and which are subject to and assembled and installed in accordance with the Minnesota State Building Code section known as the "Minnesota Fabricated Structures and Manufactured Buildings Code", 2 MCAR 1.10301 through 1.10336. Recreation Vehicle -- For purposes of this Ordinance, the term shall include the meaning of "recreational camping vehicle" as defined in Minnesota Statutes 327.14 Subd. 7; and travel trailers, pickup coaches, motor homes, camping trailers, "manufactured homes" (as defined in this Section, which are less than 40 feet in body length), converted buses, and converted vans which can be and are used as temporary dwellings for travel, recreational, and vacation purposes. Section 4. SECTION 7, Subdivision F is hereby amended by the addition of the following: 8. Permanent Foundation Required All manufactured homes as defined and allowed by this Ordinance shall be installed with a foundation system which means a permanent foundation constructed in conformance with the State Building Code, unless other- wise specifically provided by this Ordinance. Section 7. SECTION 9, Subdivision C is hereby amended by its deletion in its entirety. Section 8. SECTION 9, Subdivision C is hereby amended by the addition of the following: SUBDIVISION C - MANUFACTURED HOME PARK DEVELCPMENTS i 1. Purpose As an alternative to conventional forms of housing, the Manufactured Home Park Development procedures and regulations are set forth in order to en- courage innovations in the design of Manufactured Home Parks; to reflect changes in the technology of land and housing development; to encourage a more creative approach in the utilization of land in order to accomplish a more efficient aesthetic, and desirable residential development which may be characterized by special features of the geography, topography, size or shape of a particular property; to insure the safety and pro- tection of persons and property; and to provide affordable housing opportunities in a planned environment which is in harmony with that of the surrounding area and the City Comprehensive Plan. 2. Application Content and Requirements a. The application for a conditional use permit to develop a Manufactured Home Park shall be made on the form provided by the City and shall contain the plans and information required for Planned Unit Develop- ments as set forth in Subdivision B, paragraph 5 of this Section; the application shall be accompanied by the appropriate administrative fee prescribed by the City Code. b. Information submitted with the application shall include all other data required by Minnesota Statutes 327.16 for the State Depart- ment of Health operating license application. c. The application shall be accompanied by a proposed plan for the sheltering or the safe evacuation to a safe place of shelter for the residents of the proposed park in times of severe weather conditions, such as tornadoes, high winds, and floods. 3. Procedure The application shall be reviewed in accordance with the procedures set forth for Planned Unit Development in Subdivision B, paragraph 5 of this Section. 4. Development Standards and Performance Criteria a. Manufactured Home Parks when included as part of a Planned Unit Develop- ment or proposed as the only building unit -type within a residential j J development shall consist of at least 100 manufactured home lots, or pads, and the density of the development shall be consistent with the Comprehensive Plan and minimum area requirements of this Ordinance for j the applicable classification and district. i Page four ;Ordinance No. 82- 26 j b. The design of the Manufactured Home Park shall be consistent with the requirements contained in City plans, policies and ordinances with respect to distance of structures from public rights-of-way and property lines of the proposed site, internal circulation, parking, municipal utilities, storm drainage systems, transition, and landscaping. If i c. The development shall be consistent with applicable design standards contained in Minnesota Statutes, Chapter 327. j d. "Minimum design standards" set forth in June 1973, Department of Housing and Urban Development, Code No. 4940.5 shall be used as a guide for evaluating the design of the development. e. The shelter or evacuation plan shall be developed with the assistance and approval of the City Public Safety Director and shall be posted at conspicuous locations throughout the Park. f. All approvals for Manufactured Home Park Development Conditional Use Permits shall require that a copy of the current license issued j by the State Department of Health shall be kept on file with the City. g. The person to whom the State Department of Health issues a license shall operate the park in compliance with the Ordinance and with all applicable State regulations, and shall provide adequate super- vision to maintain the Park, its facilities, and equipment in good repair and in a clean and sanitary condition. j� h. The designated Park management shall notify Park occupants of all j applicable provisions of this Ordinance and State laws and regu- lations and inform them of their duties, responsibilities, and rights j hereunder. I . The designated Park management shall not permit occupancy of any manufactured home until the Building Official has issued a Certificate of Occupancy for the home. j. The applicant may propose the use of anchoring or support systems other than permanent foundation systems provided that piens for such systems shall be reviewed and recommended by the Building Official; and, provided that the Planning Commission and City Council consider the recommendation of the Building Official as to safety and structural integrity, and the aesthetics of the alternative anchoring or support system as evidenced by proposed skirting and landscaping. I Page five Ordinance 82-26 Section 6. Effective Date. This Ordinance shall take effect upon its passage and publication. Adopted by the City Council the 13th day of September 1982.
