ORDINANCE NO. 82-05
AN ORDINANCE RELATING TO TRAFFIC, MOTOR VEHICLES
AND OTHER VEHICLES; AMENDING SUBDIVISIONS 4, 5,
6, 7, 8, AND 9 OF SUBSECTION 1310.11 OF THE
PLYMOUTH CITY CODE RELATING TO TOWAWAY OF
VEHICLES; CONTRACTORS

THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES ORDAIN AS FOLLOWS:
Section 1. Plymouth City Code, Subsection 1310.11, Subdivision 4 is amended
to read;
"1310.11, Subdivision 4. Taking Possession, Towinq and Release. The
towing contractor shall take immediate possession of any vehicle duly
ordered impounded and shall tow such vehicle to the impounding place.
No such vehicle shall be released without authorization by the Director
of Public Safety."
Section 2. Plymouth City Code, Subsection 1310.11, Subdivision 5 is amended
to read:
"1310.11, Subdivision 5. Towing and Storage Charges. The towing charge
in connection with the impounding of any vehicle shall not exceed the
amount agreed upon in any current contract between the City and a duly
appointed towing contractor, a true and correct copy of which contract
shall be on file in the office of the Chief of Police and the City Clerk
for public inspection and reference. The said charges shall include
$5.00 per vehicle for clerical and administrative expenses of the City.
The City shall bill the towing contractor on the first of each month for
such expenses. Sums due the City for each vehicle shall be paid by the
towing contractor to the City Finance Director within 10 days following
the date of such bill."
Section 3. Plymouth City Code, Subsection 1310.11, Subdivision 6 is amended
to read:
"1310.11, Subdivision 6. Charge When Owner Appears Before Towing. When
a request has been made by the Police Department for the towing and
Impounding of a vehicle on account of a parking violation, and when the
owner or operator thereof appears before such vehicle Is in transit via
towing equipment to the impoundment location, the tow truck operator
shall release said vehicle to the owner or operator upon the payment of
a service fee not to exceed $12.00 if such tow takes place between the j
hours of 7:00 a.m, and 6:00 p.m. or, $16.00 if such tow takes place
between the hours of 6:00 p.m. and 7:00 a.m. Upon the payment of such
service fee the towing contractor shall give to the owner or operator of
the vehicle a receipt for such payment. This fee shall be retained by
the towing contractir provided, however, that the administrative fee as
provided for in Subdivision 5 shall he forwarded to the City Finance
Director together with detailed records regarding all such service .

Section 4. Plymouth City Code, Subsection 1310.11, Subdivision 7 is amended
to read:
"1310.11, Subdivision 7. Tow Truck Operator to Have Identification
Certificate. The Director of Public Safety and the towing contractor
shall jointly see to and require that every tow truck operator answering
a request by the Police Department for the towing and impoundment of any
vehicle shall have in his possession a true identification certificate,
issued by the Director of Public Safety. No person shall act as a tow
truck operator in answering any request from the Police Department for
the towing of any vehicle to be impounded without having in his
possession such identification certificate herein provided for, and such
tow truck operator shall exhibit such Identification therefor, and shall
truthfully answer any proper questions pertaining to the Impounding of
the vehicle."
Section 5. Plymouth City Code, Subsection 1310.11, Subdivision 8 is amended
to read:
"1310.11, Subdivision 8. Towing Contractor to Notify Owner. The towing
contractor shall give notice of the Impounding of such vehicle to the
owner of such vehicle as shown by the records of the Minnesota Division
of Motor Vehicles by telephone immediately upon the receipt of such
vehicle, if possible, and if it is not possible shall notify the owner
by registered mail within 24 hours after the receipt thereof. Where a
vehicle has been impounded for sixty (60) days, the towing contractor 1
shall ascertain the name of the vehicle owner together with the name of
any party with financial interest In the vehicle and within five (5)
days shall notify all such parties by registered mail. The towing
contractor shall keep a log showing all efforts made by telephone to 4
contact the owner of such vehicle and the log together with copies of i
all required written notices Shall be maintained by the towing
contractor for a period of three years from the date of such call or
written communication."
Section u. Plymouth City Code, Subsection 1110.11, 5uhdivlslon 9 1s temeruied
to read:
"1110.11, Subdivision 9. Stora a of�I.mpounded Vehicles. Any vehicle
directed to be Impounded as herein provided, from the time It Is taken
possession of by the towing contractor and during the time. It is
Impounded, and until the same: Is released to the owner as herein
provided, shall he considered to he. In the custody of the law, and no
work shall be done thereon by the towing contractor, nor shall tie permit
anyone to do any work thereon except the Impounding and storage thereof
by his enployee or his agent, until such car has been released to the
owner as herein provided. All such cars when ordered released by the
Director of Public Safety shall be released to the owner without other
charge than the impounding and storage fees herein provided. The towing
contractor during the time the vehicle is Impounded shall not permit the
owner or any other person to take or remove from the vehicle any part or I
parts, or change or repair any part or parts. All vehicles which have
been involved in criminal proceedings, and which are designated by the s
Police Department as being held for that reason, shall be held and
stored In Inside garages. Vehicles Impounded for other reasons may be
stored in inside garages or on designated parking lots."
Section 7. This ordinance is effective upon passage and publication.
Adopted by the City Council the 29th day of March, 1982.
