HomeMy WebLinkAboutCity Council Ordinance 1981-01ORDINANCE NO. 81-01 AN ORDINANCE AMENDING THE PLYMOUTH CITY CODE BY DELETING SUBSECTIONS 310.01 AND 310.03 AND ADDING SUBSECTION 310.05 THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES ORDAIN, AS FOLLOWS: Section 1. The following is added to the City Code as Subsection 310.05: 310.05. Public Safety Department. Subd. 1. Creation. There is hereby created a Public Safety Department for the City ofymouth. Subd. 2. Purpose. The Public Safety Department shall be responsible I for the equal protection of all persons and property, fair and just enforce- ment of all applicable laws of the State of Minnesota and ordinances of the City, the prevention of fires, the removal of fire hazards, the rendering of i fire fighting, the preservation of the public peace and order-, the prevention and detection of crime, the apprehension of offenders, the rendering of civil defense services, and the development and implementation of a program for the j education and training of both employees, volunteer, workers, and citizens of ' the City respecting matters involving in particular all the foregoing purposes' and in general, the safety and well being of the community at large. Subd. 3. Organization of the Public Saf,ty Deeartment. The Public Safety Department shall consist of a Police Department Division, and a Fire Department Division. j Police Department Division. The Police Department Division consists of a Police a Chief -and —succ h offer members as may be determined from time to time. The Director of Public Safety may serve as Police Chief. The Police Chief and other personel of the Police Department Division are appointed by the City Manager for an indefinite period. The Police Department Division shall be under the direct supervision of the Police Chief who shall be responsible to and under the direct supervision of the Director of Public Safety. All mem- bers of the Police Department Division subordinate to the Police Chief shall j obey the instructions of the Police 0 ieF and any superior officer. i Fire Department Division. The Fire Department Division consists of a Fireit;ii ef, and such other subordinate officers and fire fighters as may be determined from time to time. The Director of Public Safety may serve as Fire Chief. The Fire Chief and other personnel of the Fire Department Divi- sion are appointed by the City Manager for an indefinite period. The Fire Department Division shall be supervised by the Fire Chief who shall be re- sponsible to and under the direct supervision of the Director of Public Safety. All members of the Fire Department Division subordinate to the Fire Chief shall obey the instructions of the Fire Chief and any superior officer. f Ordinance No. 81-01 Page Two 4 Subd. 4. Director. The Public Safety Department shall be under the direction and supervision of a Director of Public Safety who shall be ap- pointed by and subject to the supervision and direction of the City P•'anager. Subd. 5. Duties of Director. The Director of Public Safety shall be responsible to the City nager or all aspects of public safety including all fire and police activities relating to the fair and just enforcement of all laws, statutes, and ordinances and the preservation of justice, law and order in the City; the direction of civil defense activities within the City, the assignment of personnel within the Public Safety Department, and for developing and implementing selection procedures for personnel of the depart- ment with assistance from both Police and Fire Chiefs. Subd. 6. Relief Association. The members of the Fire Department Divi- sion may organize themselves into a Firemen's Relief Association. Section 2. Subsections_21-0.01 and 310.03 of the Plymouth City Code are hereby repealed. Section 3. This Ordinance shall bec.Jme effective upon publication.
