HomeMy WebLinkAboutCity Council Ordinance 1979-31ORDINANCE NO. 79-31 AN ORDINANCE RELATING TO STORM DRAINAGE: AMENDING ORDINANCE NO. 79-19 ESTABLISHING STORM SEWER IMPROVEMENT TAX DISTRICT NO. 3 ELM CREEK WATERSHED THE CITY COUNCIL OF PLYMOUTH ORDAINS: Section 1. Authority. The City is authorized by Minnesota Statutes, Sections 444.16 to 444.21 the "Act") to establish storm sewer improvement tax districts for the purpose of constructing and financinq_ storm sewers and related facilities within such districts. Section 2. Findings. The City Council hereby finds and determines that it is necessary and desirable for the proper control of storm drainage and flooding in the City to use the authority contained in the Act to create a storm sewer improvement tax district. Section 3. District Created. Storm Sewer Improvement Tax District No. 3, Elm Creek Watershed the "District") as established by Ordinance 79-19 is amended. The amended boundaries of the district are as follows: REVISIONS TO THE 8/20/79 DESCRIPTION OF THE ELM CREEK WATERSHED BOUNDARY 1. On page 1, line 8 change; "NW h to NE h" 2. On page 2, omit lines 21 through 23 in their entirety and insert; "NE 4 to the northeast corner thereof, thence westerly to the east line of the west h of the NW 14 of the NE 1thereof, thence northerly along said east line to the south line of the SW h of the SE 4 of Sec. 5, T118N, R22W, thence west to the centerline of Dunkirk Lane, then northerly to the northwest corner of the NE h thereof, thence easterly along the north" 3. On page 2, omit lines 25 through 29, in their entirety and insert; "the SW 4 and the SE h of the NW k of the southeast Inv Section 4. Effective Date: Filing. This ordinance is effective on the day of its publication in accordance with law. The City Clerk shall file a certified copy of this ordinance with the County Recorder of Hennepin County. Adopted by the City Council the 3rd day of December , 1979. Mayor Attest: City Clerk
